- GinaI got a call from them about 3PM today. It showed up as VOXEE, INC on caller ID. I didnt try an call back.

I called the dumb [***] she won't answer the phone. Two problems here I live in south Carolina and not even close to district 12 and I don't even write checks so when she or if she calls me back it's gonna be on like donkey kong.

Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?
The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.
Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

I said Hell no!! U are suppose to have it since your'e the one that's calling me. I knew something was strange because I don't write check and I don't do pay day loans and i don't live in district 12. After i told her all this she said just disregard the call. Really lady!! People just be careful of the things that people will do.
- Tom| 1 replyI am being accused of not paying back a payday loan. They are threatening me with 3 felony fraud charges. They are harassing one of my family members with repeated phone calls. They have a lot of my personal information and I am worried about Identity theft. I spoke with an Amy Ford and an Amy Schwartz all they say is that they are with district 12 check fraud division. When I do an internet search on the number it says Washington and some reports of this number also mention Colorado so I am filing complaints in both Attorney Generals office and I have also filed a complaint with the Federal trade Commission, reference number: 41573007 as of 11/1/2012. I do not have any documentation from them, they state that they were all sent to an address of I place I lived three years ago. They say they have a corporate office in Colorado I also spoke to a Director Jonathon O'Brien I do have recordings of my conversations with Mr. O’Brian and an Amy Schwartz

- bravo61st replies to TomI'm replying to this because I too received a call from these idiots. They claim to be investigators of the District 12 Check Fraud Division. They never identify where or who they truly are. Basically they answer questions with questions. I have worked in law enforcement for about 10 years now, and since receiving the calls I have contacted many agencies, I am also going to be speaking with the FBI about these individuals. It appears that people only have contact with two individuals, a Jonathan O'Brian and Amy Schwarz. They threaten individuals with criminal prosecution for civil debts. A loan is a loan is a loan is a loan, which is a civil matter, they try to pressure you into paying within a certain time period and the common theme seems to be about $700.00 based on my research. When I spoke with them I hammered Schwarz with questions about who she worked for, I wanted the name of the agency if she was with one and where they were located, I was hung up on, I told her I was in law enforcement and that she just contacted me, so she needed to start answering some of my questions before I answered hers, she kept asking for my case number and would not give me any further info. Now with myself working in law enforcement if I call someone and they ask me to identify myself, what agency I work for, where I'm located, I provide that information immediately, these guys use vague, general language to avoid associating themselves with any specific agency. The FTC has already been contacted, I too was threatened with Felony charges and told that there would be a unit dispatched to my location if I did not pay. I was told the prosecutor wanted my paperwork filed that day. I have never received a validation of debt or any such paperwork. I asked where the prosecutor was located O'Brian stated in Dallas. Why are they calling from Colorado if the prosecutors office is in Dallas? Is this a federal agency they work for? The answer is Nlo. This company seems to have just recently arrived on the scam scene. There is not alot of information about this company, but the calls slowly seem to be racking up. They need to be stopped, because they are going to scare the hell out of someone enough to pay. I knew things weren't right when they read me the apparent affidavit and asked quilt seeking questions without mirandization any law enforcement officer would have done this, and of course identified the actual agency he worked for. When they are pressed for the agency or company they work for they will hang up the phone. O'Brian even told me he was a police officer at one time, what before he became a scam artist? Do not give these individuals information, and as convincing as they sound do not let them pressure you. FTC requires a debt collector to provide proof and validation of the debt upon receiving a call form the collector. It is also your right to be free of harassment and thrests of criminal prosecution. You can not be prosecuted criminally for a debt. Debot's jail is unconstitiutional and believe me if people were prosecuted criminally for a debt they failed to repay, the jails would be full. Again I am going to be speaking with an acquaintance or two with the FBI, I am definitely going to have this company investigated. You Tom are not violating the law, they are.
- bravo61stSorry I meant debtor's jail was outlawed long ago. The problem is there are so many scams out there with payday loans. These "Loan Sharks" prey on the financially challenged individual, then if they don't receive payment they use whatever means they can to try to collect the debt, many times they violate the law in their collection practices, and threaten to arrest individuals. You must ask yoursel for what? And also ask yourself if you were them and went to a law enforcement agency would they even entertain the thought of pressing charges, the answer is NO. Once an officer hears that it is a loan, they would pretty much tell them to consider suing the person and that this is a civil matter. These companies know the risk they are taking and again revert to illegal collection practices if the debt is not paid to their satisfaction. ACH tansaction are not "checks". This is why it's called an Automated Clearing House transaction. Nowhere does it state the word "Check" If you actually physically wrote a check it would be a different story. My Auto Company uses ACH to take my payment, if the funds are not available on the date I have authorized the Auto Company cannot come after me for "theft", Fraud, or bad checks, they may repo the car and sue me for the balance but again it's not criminal vioation. Same goes for a loan, if you fail to repay the loan the company can sue you in civil court, There are two types of debt you can go to jail for in the U.S. One is defaulting on STUDENT LOANS and the other is in some states CHILD SUPPORT, And even with Student Loans most of the time they will just garnish your wages. Many states are outlawing payday lenders, because of their incredibly high interest, and again the company then reverts to using illegal means to try to collect. I wish they would outlaw all payday lenders, but we are the land of the free, but maybe with a little support, and many calls to your state's representative and AG''s office we can rid the states of this cancer once and for all.
