- BigA replies to Emily| 2 repliesWell until you do something. Like try to get enough information to report them. Tell them that they cannot call your employer and have your family tell them that they cannot keep calling them. If you can get any information on them then post it here.
One of the tricks they use is to call your family, friends, neighbors and/or places of employment (past or present or both) to create panic and embarrassment so that their intended victim calls them so that they can scare that person into paying extortion money. They will usually also state information that would be illegal for a real debt collector to state to a third party such as that you are being sued, that you owe money to someone, etc. They threaten that if you do not call them back, they will contact your HR department and tell them that you are a deadbeat who does not pay their bills. They often call people that have never even been associated with you because they get erroneous information off the internet.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

- Emily replies to BigA| 1 replyThank you. I have filed with BBB and attorney general so far. I have tried to get mailing address and they hung up on me. I am so frustrated with this situation. I work for a public school and they are telling my superintendent that they will come on the property to serve me. I have contacted two separate attorneys, the first wouldn’t help he said it isn’t a matter a legal office can help with but I should rather contact Attorney General to report this and out an end to it. I have an appointment with the second tomorrow to see if there is anything I can do legally to put a stop to the calls.

I won't make any promises but the more information that you can play them for the better. - KatieThey just called me and the caller ID popped up "MARION FLOWERS" They gave me a number to call and a claim number, but had no information on what was happening just said I needed to call that number, she couldn't even give me the companies name or anything. Then the woman on the phone proceded to tell my husband he owed a debt and was being sued for defrauding a company and all kinds of issues and we needed to pay the amount in full and all kinds of stuff. She had his old address, email, last 4 of social, and all kinds of information. That they were suing him and locating him for court and they were willing to settle out of court and all kinds of random [***]. She said they were a "pre-trial office" and the company was called "Enterprise" so the first woman that called me and the second call center must be working together to defraud people.
