- Fed up| 2 repliesThis is a collection department, they go by Stern attorney at law. There is a really nasty old man there named Dennis Mitchel. He will out talk you regardless of you trying to speak, he will scream and yell at you, he will leave cruel, mean voicemails on your phone. And I wish I knew what I could do about it!
He calls from 1-919-755-3900 but leaves the call back number as 1-800-455-0260. But I add the 919 number to my address book so when he call it will come up as bill collector and his name so I know not to pick up.- Caller: Stern attorney at law

§ 807. False or misleading representations [15 USC 1962e]
A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:
(1) The false representation or implication that the debt collector is vouched for, bonded by, or affiliated with the United States or any State, including the use of any badge, uniform, or facsimile thereof.
(2) The false representation of --
(A) the character, amount, or legal status of any debt; or
(B) any services rendered or compensation which may be lawfully received by any debt collector for the collection of a debt.
(3) The false representation or implication that any individual is an attorney or that any communication is from an attorney.
(4) The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action.
(5) The threat to take any action that cannot legally be taken or that is not intended to be taken.
(6) The false representation or implication that a sale, referral, or other transfer of any interest in a debt shall cause the consumer to --
(A) lose any claim or defense to payment of the debt; or
(B) become subject to any practice prohibited by this title.
(7) The false representation or implication that the consumer committed any crime or other conduct in order to disgrace the consumer.
(8) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed.
(9) The use or distribution of any written communication which simulates or is falsely represented to be a document authorized, issued, or approved by any court, official, or agency of the United States or any State, or which creates a false impression as to its source, authorization, or approval.
(10) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer.
(11) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action.
(12) The false representation or implication that accounts have been turned over to innocent purchasers for value.
(13) The false representation or implication that documents are legal process.
(14) The use of any business, company, or organization name other than the true name of the debt collector's business, company, or organization.
(15) The false representation or implication that documents are not legal process forms or do not require action by the consumer.
(16) The false representation or implication that a debt collector operates or is employed by a consumer reporting agency as defined by section 603(f) of this Act.

- Disgusted Client| 10 repliesIf ever you have to deal with Stern & Associate, ask God for grace and tolerance. One of their employees, DENNIS MITCHELL, is a very arrogant and nasty old man. He has absolutely no manners, no people skills whatsoever, a terrible listener, and one who hangs up on his clients.
Companies who use this agency should also be careful since DENNIS MITCHELL is hanging up on the clients you are paying Sterns & Associates to collect from; so you may never recover a dime because of this abnoxius old man!!- Caller: Stern & Associate

There was a clerical error on his client's end, and though I understand "fighting" on their behalf, he was highly obnoxious, screaming, and slammed the phone on me abruptly. Dealt with the client from then on, told them about him, and they were very understanding about it...I guess it's not the first they've heard about him like that. - Mike| 3 repliesI can find this Dennis Mitchell. That is most likely his collection agency name. I have over 30 years investigating strong armed collections agencies. I have worked with federal and local officials in stopping these practices. Let's find "Dennis"!

i have no sympathy at all for your broke bums. I actually dealt with Dennis Mitchell and we discussed it maturely because I knew it is my responsibility to pay for something i received. we setup a payment plan, i made my payments, and that was the last i heard of it.

- boo radley| 3 repliesI worked there. they're crooked. you should pay your bills but s&a is crooked, not only with debtors but also with their employees. most of the people that work up there are stupid college kids with no sense of self-reliance or pride for that matter.

I had spoken with them a few months back explaining we were really having financial difficulities and I did not have any money to send now. Today I called back and received a rude, argumentive Dennis Mitchell. I tried to explain to him my Disability Check only covers my house payment and utilities and my husband was an Auto Tech who only got paid if he had work. He smarted off at me that he should look elsewhere for a job. There were plenty of job openings for Auto Technicians. I told him obviously he knew nothing about Auto Dealerships today, or he would know they are laying off people and closing down. My husband is no rookie, he has been in the business for 35 years. He told me if I did not send in the money for this bill (over 2 years old), he would take legal action against me. I told him to do what he had to do. I had to have a place to live and knew my limitations. He made many other smart remarks about me only sending in $5 "when I felt like it", and I told him it was "When I had it, because most of the time we do not have grocery money". He said he did not care, all he wanted was to collect this bill. This man should be behind bars. He threatens people like he is God and all he is to me is a little man who is a Total Jerk and will some day, get his reward. "Vengence is mine, thus said the Lord God of Host".

There are lawyers that specialize in collections, so before you start quoting the law, please make sure it is in the right context. More importantly, make sure that you are correct, because you are not. There is nothing worse then being obnoxious and wrong.

I have no clue what this is about or why he is calling me. I have had surgery's and have never seen a bill because my husbands insurance is so good. He told me to call him at 272-0800.
