My mother passed away a couple of months ago and she had credit card dept. B of A and Citi Bank wrote them off but Discover didn't. This number is a collection Agency trying to collect money for Discover card debt. This number along with a few others tied to this Agency call me several times a day from early morning (7:00am) until late at night (10pm). My father is on a fixed income and don't know how he's going to pay this bill since there wasn't any life insurance

if the credit card was in your mother's name only no one else is responsible for the debt.  If there is no estate the debt must be written off by Discover. Let them know there is no Estate, no money.

This is a scam!!! Do NOT give them info about any thing! They called me on my cell phone that has NO service here in the USA! (It’s a Swedish cell phone) I was using WiFi at my fathers house when the call came in. They wanted me to pay a debt on a bill that was made up and didn’t exist. (Dental bill from January 18 2018) I’ve been living in Sweden for 27 years!!!  Talk about dumb [***]!!! Haha... A new Microsoft technical support scam!!! Haha... DON’T fall for this BS!!!

You MAY live in a state where he is not legally obligated to pay it. If the card was in her name and he was only an authorized user, most states will not hold him responsible, but check your state. You also can demand in writing that they stop contacting you. Best of luck.

Traci posted back on 25 Oct 2017 and it is highly unlikely she will read or be able to use your info this late in time.
Just so you know, an Authorized user is very different from an Account Holder and is under no obligations to pay on any debt to the card issuer. Just like your employer might have a card to allow employees to purchase things for an office, its the Card Holder (the one who has the account in their name)  who is responsible for paying on the Card, not anyone who is allowed to use it.

I'm not 100% sure that applies in the 8 community property states so people should check their state laws as well as federal laws.

Very true, and I hope so for her sake; however, it may help someone else to know what their rights are.

    The ex-wife
They are calling about my ex-husband for debt that he had after we got divorced.  This is not the only company who calls about him.  I'm not responsible for his debt nor his estate, which is intestate and has not gone through probate - AND WILL NOT UNTIL THE 2 YEAR STATUTE OF LIMITATIONS IS UP FOR CREDIT CARD DEBT.  So no, I'm not calling them back.

My father in law died a few months ago. Not only did this scammer call my husband, they also called his brothers, none of whom had anything to do with their father’s accounts. It’s a total scam, meant to take advantage of grieving families. I’m hoping they didn’t try to reach out to my mother in law.

You will need to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), cease and desist calling, or "not me" letter (this will be the best money that you have ever invested).  Also send it first class mail in case no one will sign for it.  Make a notation of that fact at the bottom of the letter.  You also need to report them to the proper agencies to which I have provided links to.  Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment.  If everyone did these three things, these crooks would be bankrupt, and we would all be the richer for it.  Use these web sites to find an attorney in your state that will probably take the case on a contingency basis (no money out of your pocket up front):  http://www.consumeradvocates.org/

Everything else you need to know follows including at least two or more federal and state agencies where you should report their criminal activities.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

Also file complaints with the FTC: https://www.ftccomplaintassistant.gov/#crnt&panel1-1

Also file a complaint with your State Attorney General's office.
List of State AG’s offices:   https://800notes.com/faq/attorney-general

Also file a complaint with the Minnesota Dept. of Commerce:http://mn.gov/commerce/consumers/file-a-complaint/index.jsp

Since they claim to be lawyers, also file complaints here as well: http://lprb.mncourts.gov/complaints/Pages/default.aspx
