Lady called from 817-817-904-2951 and told me that I was being sued and that Tarrant County was looking for me and would go to my place of residents as well as my work if I didn't contact 877-537-3968 to get the legal matter take care of. I called the 877 # and they actually knew of a loan I took out last year that I never paid, but they also what all of your information. I called back both #'s and they both just ring and ring because I told them I needed to verify the information and find out if I'm really being sued. What I think it is is that the scammers get your info from these collections and try to use it. she knew my moms address as well as the last 4 of my social... it is crazy how these people get all of your info...

If a civil complaint has been filed at the courthouse then it is a simple matter to call your local courthouse and ask if you are being sued.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

Also file complaints with the FTC: https://www.ftccomplaintassistant.gov/#crnt&panel1-1

Also file a complaint with your State Attorney General's office.

I got a "legal" threat and was told to call 877-537-3968 too. Involving a person that was assigned to be living at my parent's house for an Osceola county case. It was STRONG in a threatening matter. Thanks for posting about your experience. It really scared me.

I just got another call from the same number but the lady had a different name. Said that I was in default with the courts and the will be coming to my job. I sent pictures to the number of everything online and tried calling back and I have got nothing back. Casey Smith was the name used today and I kept the voicemail because I hung up in their face and they called back and left a message. If it is legal they will not be calling from a cell phone first off it would be from the county that the suit was filed in. These people need to get a real job like everyone else they are trying to take money from. I changed all my bank info just in case they tried anything. Claiming to be with Tarrant County.

Also I took pictures of all these websites saying they are scammers and everything and sent them to the phone that keep on calling me and let's just say it isn't a land line because the messages went through. They are using a cell phone and also the number is a Grandbury phone # not even Tarrant County.

IF there was REAL legal action, you would NOT be warned.  Read BigA's excellent post near the top of this page on what to do..
