- NicoleI got this call from Emily Stone saying I owe all kinds of money from a closed account from over 10 yrs ago from u.s. bank saying if I didn't pay it I would have to go to court. She wanted 10 payments of 150.00 bi weekly. Also wanted me to send her my driver license along with my debit card number. It's very scary

- Cornelio| 5 repliesI got a call recently from Emily Stone. She says she is a dept collector with Lincoln Equity and that a 10 year old dept is in her litigation office ready for court. When asked about a Statue of Limitations (SoL), she claims there is a Tolling agreement that waves the SoL, but refuses to give me any details about the agreement. I'm not sure if she is a scammer or not. They recently "upgraded" their office to one in LA with a new number 323-638-1245.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

I knew something was up when she wanted me to send her a picture of my driver licenses and my debt card. She sounds very convincing tho

That is also a federal crime. It is issued by the federal government, Report it so you can have a police report if you have to go to court over something she did.
