- Cassandra replies to margaret| 1 replyYes it's a scam, I received the phone call this morning, missed it but they left a voicemail, I asked abunch of questions they couldn't provide me with some information such as address to the company the debt was with, they could only tell me county, in asking all my questions such as who with, what year, what was my address, what bank, ect. I realized all this information is on my credit report, but the year they were trying to use that information from was 5 to 13 years off from the year they had given me for said debt. And the county I supposidly lived in at the time and the county of debt are an hour and a half away from each other. They even provide me with my SSN and birthday they didn't ask for it. I told them it's fine I will go to court. I did write all information down as I was on the phone with them and I immediately turned it in to the Oklahoma State bureau of investigation, FBI, and federal trade commission also had to file a report with ftc for identity theft since they do have all my information. They all three stated it's a scam, and if you get this call or similar do not engage at all! If anyone threatens with pay or court report it immediately it is either a scam or they are using illegal tactics. Ask for a letter if debt, they must provide you with such and within 30 days. Even if they say they have, ask, if you have never talked to them before. Report this number and any information you have to all three above mentioned agencies exept to your own state bureau if not in Oklahoma.
- BigA replies to CassandraThe dunning letter must be sent automatically within 5 days of first contact. Once you get that, if you want a debt validation, which you should always ask for, you have to send them a letter within 30 days of receipt of the dunning letter. They actually have an unlimited amount of time to validate the debt.
- BigA replies to margaretIt is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
