He found me today stating that he needs to serve court papers to me from a company called Trademark. He could give me a "claim" but couldn't tell me if I filed the claim or this company called Trademark did, Anyone else getting these calls?? The phone # he wants me to call is 844-211-3154

He knew my address (at least the correct street that I live on) but didn't mention the house number. My S-I-L just called and said she received another phone call from this Thomas guy, right before I got the call. He said he needed to report to the company, that he did locate me and wait to see if I returned the phone call or should he continue and deliver the papers. He would wait for further instructions. Sounds like he watches too much TV.. Thanks for the info!

- MJ| 5 repliesI received a call Friday from this company saying they had important legal documents to deliver to me, unless I called back and tried to set something up. They were willing to arbitrate an agreement between me and an old payday loan. I agreed to a payment schedule, but if this company is not real I will be placing a stop payment on them. Does anyone know if this company is real and actually arbitrates these types of deals? I will leave the scheduled payments as is if that is the case. Any information will help. Thank you.

- MJG replies to MJDid you receive WRITTEN DOCUMENTS that were MAILED to you? That is official notification of debt ...phone calls, emails and faxes are NOT recognized as official. They have FIVE DAYS to comply ..accept no excuses. That is the law.
THE DOCUMENT MUST GIVE THEIR OWN COMPANY NAME AND ADDRESS as well as the original creditors, dates, amounts, etc. It is also illegal to make threats, should that happen. REAL process servers do not warn you. That is a typical scare tactic. - BigA replies to MJ| 3 repliesTrademark is a known scam operation. They use the "we are going to sue you" as a threat to scare you into paying them money (extortion). Sorry but process servers do not call ahead. They get paid to deliver papers, they don't get paid if they don't deliver them. As MJG has said, if they have papers to be delivered, then the case has already been filed. Your local court clerk will verify if that is really the case. In the meantime, you need to learn what your rights are and how to deal with these people. You say that it is an "old payday loan" there is a thing called the Statute of Limitations that when expired prevents them from legally filing a lawsuit unless you make a payment in which case it resets.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

The woman that I answered was the same woman that I spoke with Friday. She said she would be contacting the woman in my jurisdiction and having the papers served to me tomorrow. Is this something I should be concerned with?
- BigA replies to MJ| 1 replyEverything you need to know is up there in that post. Let them serve you. Big deal. You go there with a lawyer and make them prove that you owe the money. They won't be able to. You also sue them for FDCPA violations and they pay you money. A good lawyer should take that on a contingency basis. Remember, no one gets a heads up from a process server. Too many people would dodge the papers. No doubt someone will call you tomorrow and tell you they have papers to serve between such and such a time and that you need 2 forms of ID and a supervisor, etc.
I have been threatened as well by different debt collectors. I haven't ever paid any one of them anything because I stood up to them, made them follow the law, and once i did that, they folded. the reason they folded? Not because i owed the money, but because they were trying to scam me out of money that I didn't owe. - MJ replies to BigAThank you. According to other posts I've seen on other sites, this company will have someone come and the person will ask me to contact trademark before serving me the papers to "work out a deal". I asked them to cancel all future payments today and will be placing a stop payment on them just in case they attempt to withdraw funds. I appreciate your replies!
