- never ending scam loop| 2 repliesReceived a message on my work and cell phone stating "My name is Samantha Lumbart and I am calling on behalf of San ******* County Services. It looks like I do have you on schedule for you to sign a certified notice of intent to appear in court. I just wanted to let you know that I will be stopping by your place of employment between the business hours of 3-5 pm eastern standard time. If you cannot be located at your place of employment, I will stop by your place of residence. If you have any questions, concerns about your claim please contact me directly at 844-211-6193." Classic scare tactic to get people to call them by making them think they have a serious legal issue that needs to be addressed. They threaten to serve you unless you take care of the problem by giving them money. I did not call back, no need to, I know the routine. Also, this call came in yesterday morning, no one showed up at my business or home to serve me. Another thing, I am in NM, as I assume she would be if she was planning to serve me, why she mentioned eastern standard time goes to show me that they are calling from out of state to net victims.

- Tess replies to never ending scam loopPlease take note that yesterday I got a call from that very same number and they were lawyers and today I got a call from another number connected with them that are process servers.Yesterday they were in New York, today Tampa. Everyone should go in and file a case with the BBB as well as report them to the FTC. Know your state, the payday loan laws for your state as well as the Statue of Limitations for Debt Collections. If you make even a Small payment it will restart the clock, so also be aware of that.
- SeattleScamI too just got a call today - Finally they left a VM - My phone has been ringing off the hook from various locations like FL, TN and said they needed to verify employment, I commited fraud, I needed to obtain a lawyer. I've dealt with these types of groups before and they are a scam and all I've done is filed a complaint against them and it stopped. If this were an actual collection agency on behalf of a payday loan - Letter would be sent with the Loan Originator - The official Debt and then if not paid/Settled they then could take to court but not try to contact you at your place of work and hassle you and say they are going to arrest you etc. I tend on filing a complaint on the federal site if anyone else wishes too and how convient this is right around Tax Season.

- Gale| 14 repliesCaller left message on my answering machine. Went something like this:
"This is Asset Management LLC. We are calling to verify employment and location information regarding claims of lawyer fraud and bounced checks being brought against you. If you have retained an attorney to answer these charges or would like to make an official statement, we will consider our job complete in this matter. Call us at 844-211-6193 before 4pm."
I have also received letters from these people, but I never even opened them up. I just tossed them into the trash. These are horrible people using fear to bilk people out of their hard-earned money. They make me sick.
Just for those folks who may in fact have a bounced check out there in the world --- (although, who writes a check anymore???) ---
If you do bounce a check, whoever you wrote the check to will call you or send you a letter telling you that your check has insufficient funds. After all, they want their money. Bounced checks ARE NOT treated like debts. The person or company you write a bad check to is not going to hire a debt collector to get the money out of you. If they ask you to pay and you refuse, or if they mail you a certified letter and you don't contact them or the letter is returned, they will take your bad check to the court and file charges against you. Writing a check when you don't have the money to cover it is considered "theft" and is against the law, but everybody knows that accidents with bank accounts happen; so both the person you wrote the check to and the court will usually give you ample opportunity to make the check good.
Before any legal action can be taken against you, the person you wrote the check to has to be able to prove to the court that they tried to contact you for payment. You will be responsible for both the amount of the check you wrote and the amount of money the persons bank charged THEM for depositing a check with insufficient funds. This extra amount is not the same as the fee your bank may charge YOU for writing a check when your balance was not sufficient to cover it. The court also charges fees to the person filing the charges against you and this amount will be added to the total amount you owe. A $20 bounced check can easily wind up costing you a $100. Anyway -- When the court sees that you've written a bad check, that you've been contacted about it, and you have not made any effort to pay the person you wrote the bad check to, a judge will issue an arrest warrant and the sheriff will come looking for you -- usually at home. You CAN be arrested for writing a bad check, so if you have one out there somewhere, you need to take care of it.
No bill collector is going to call you trying to collect your bounced check over the phone. The courts do not hire debt collectors or "asset management" people. They have a sheriff to bring you to court and a judge to see to it that you pay. A bounced check is not a "debt". If you have any concerns about whether or not there really is a warrant out for your arrest or whether or not someone has filed a civil suit to collect a debt from you, call the Clerk of Court in your county of residence and ask. They will be happy to tell you. Bounced checks and Fraud are serious matters. That's why these scammers us use them in their ruse.
I used to work for a grocery store chain and it was my job to go to the court house and take out warrants on people who had written bad checks and then refused to pay for the check and the bank fees. I have stood in a courtroom as "plaintiff" in many bounced check cases. The best thing you can do if you ever write a bad check (by accident, of course) is to try to pay as soon as possible. Contact the person you wrote the check to and even if you don't have all of the money you need to pay for the check and the bank fees, TRY to pay the check amount. If they accept that, most states prohibit them from getting a "bad check warrant". You might be able to negotiate a payment plan for the bank fees.- Caller: Asset Management LLC

- connieI have had them contact relatives saying the same thing as they have said to everyone else. They call several times a day leaving messages, it is harassment I have paid all my bills and I don't write checks I don't know anyone who writes checks really so anyway they are the ones who need to be taken to court!!! They also should know the laws before they call people and leave messages especially in California you cannot intimidate so by saying they have papers and they are going to serve you at your home or business especially when they aren't even licencened to do so is illegal.

Some sort of phantom operation. Absolute debt scamming operation. Ignore and block.
report them:

The same goes for endless telephone harassment

If they continue to bother you, and you know you do not owe any money, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.
You'll probably have to yell at them and talk over them.
You have to get tuff with these people because, being akin to thugs, brute force is (metaphorically speaking), the only thing they understand.- Caller: Informational post

- Steven replies to Gale| 13 repliesWell stated, but there wouldn't be a actual paper check when you authorized an ACH. An ACH is considered a check and therefore treated the same. When someone takes out a payday loan they authorize the lender to take a agreed upon amount out of the borrowers checking account by authorizing a ACH. When the lender attempts to take the money and it comes back as insufficient funds it's now check fraud as well as defrauding a financial institution. Do I agree with the way collection agencies conduct business " ABSOLUTELY NOT," but no one gives away free money so if you borrowed it you need to pay it back. Come on now, everyone of u knows damn well you took out a payday loan. If people spent as much time working as they do trying to get out of paying their debts and being a responsible adult you wouldn't have to deal with these people.
