It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
•is seeking payment on a debt for a loan you do not recognize;
•refuses to give you a mailing address or phone number;
•asks you for personal financial or sensitive information; or
•exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
•Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.
•Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
•Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
•Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
•Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

and I didn't request an email address b/c once i actually listened to the allegations I immediately realized it was something that i did and wanted to handle it voluntarily ......i also seeked legal aid and had them contact the company for validation of my debt. - Slim replies to Michelle HallMichelle -

That statement does not make sense.
Yes, entering litigation makes the case public record ... why not? Scammers would prefer not to have their nefarious activities publicised or subject to legal scrutiny.
Scam organizations do not purchase debt solely in order to litigate. Litigation costs money. They would prefer to scare people into sending the money without going through the legal process.
ALL collectors MUST follow FDCPA rules ... including the snailmailing of specific documentation within five days of initial contact. If the collector does not follow FDCPA rules, THEY can be sued or otherwise penalized!

- Michelle Hall replies to BigA| 10 repliesNot that my case is any of your business however i have no problem sharing ....even though you have already formed an opinion on who I am and my purpose on defending myself and my opinion.....I could easily say you are from another company that's writing bad reviews so people can pay your company.....but anywho my situation was I had received a loan from Western Sky and didn't pay it back ....I closed my account because I was drowning in debt and digging a deeper hole for myself by trying to keep my account current and active......so while my case was in the attempts of collections I simply couldn't afford to rectify it .......So prior to them submitting it over to my county for court I was offered the opportunity to voluntarily salvage the situation ...and I did so once I had legal aid further investigate the company.....

During the process of New York (and, possibly other states) suing Western Sky Financial, people were given the opportunity to submit a claim form for a refund of the excessive interest (and possibly other monies). Did you submit such a form?

We did not ask for your "paid in full" documentation, since such documentation is, essentially, meaningless if issued by some scammer. Again, the supposed debt holder MUST give you certain information BEFORE you pay, according to FDCPA rules. If you did not get that written/snailmailed info BEFORE you paid, there is an excellent chance of a scam. As previous posters have stated, if you really sent the money, you got scammed. Otherwise, there is a good chance you are shilling for some company whose name / address you refuse to give. Your accusing BigA of being an employee for some other loan company strongly suggests the latter alternative is the true one. - BigA replies to Michelle Hall| 8 repliesI would have posted more but I was on a mobile device earlier. "and I did so once I had legal aid further investigate the company" The FDCPA and various state laws all state that the debt collector must verify and make valid the debt by obtaining the information from the original creditor. So why you would go out and get a "legal aid" whatever to "check this company out" is beyond me. If he was indeed educated in the law, this "legal aid" should have informed you of this. The FDCPA spells it out in plain language.
Now two other things, first you still have not told us the name and address of this alleged law group that you claim called you. This is certainly not personal or privileged information since these people, if your claims are true, are attorneys and as such are registered to practice law and their names and company name are public information.
Secondly, if you want to accused me of being an employee of a debt collection firm or a pay day loan firm, that is of course your prerogative, but let me tell you that I would much rather live in a refrigerator box in Antarctica eating frozen beans out of a can before I ever stooped so low as to be an employee of either of those two criminal enterprises. - Meme replies to Michelle Hallha I think you work for ASG!

- Smart One| 1 replyThey re at it again with a vengeance. Using- 866-232-0957 Husband got repeated calls at his place of employment saying they were a "location services" firm looking to issue him about a court summons. They got the operator and asked for his supervisor. Supervisor told my husband about the call and when we called it and we figured it was a scam the second we heard ASG. Not to be deterred... they called random people at his work the next day. I called them and got an Amber Johnson who forwarded me to Bethany Williams. I asked them if they were aware that what they are doing is illegal. She wanted me to give my out my husbands birthdate and social. Not going to happen. She became irate with me. These were the lies she told in no particular order. 1. My husband will be detained and taken away to court that very day and got to jail. 2. They do not have to follow FDCPA because they are a legal firm. 3. When I asked for a full name and legal address- she said ASG was not an acronym and didn't stand for anything (probably because when you google it- it becomes clear what a scam it is). I called the county sheriff. He said it's a scam and I should call the police. I called the police and they said to file a report with the IL State Attorney who has been going after this kind of fraud. So I did. I know it's bogus... but what a way to ruin a day. It make it really hard to be Christian with this kind of scum running around.
