Received a call saying that a complaint was filed against me. They would not say what type
of complaint or give any information. I refused to answer any questions until they told me
what it was in regards to, they never did, they began saying that they had to hand me off to
a "Case Manager" to tell me what it was about. I hung up and called the number back.
When I asked what the name of the company was they hung up, I called back again, I got
the name of the company RMA Recovery Group, LLC, 626 North French, Suite 1, Amherst,
NY 14228. Then my husband spoke with "Officer Baker," he asked several times what
agency the officer represents, he never answered, call my husband f'ing stupid, asked if I
was "too [***]" to talk for myself and continued to berate my husband and myself with
insults and threats. None of the information he was verifying was mine. I told him that and
he continued to insult and intimidate me and my husband on a debt we do not owe.

I received voicemail this morning stating they are filing a suit against me and will be serving me at my home and place of employment tomorrow and that I need to have 2 forms of ID available. He had the last 4 digits of my SSN. He stated that I needed to call 844-857-9507 and I tried to call it back and it said the number was no longer in service.

Received a call saying they have a complaint against me. They also said I took out a payday loan which I've never done. She told me that she sent several correspondences which I've never received. When I told her to send them she became irate. She started talking about getting a supena for me to appear in court. She said I may as well pay that because court will cost more. I told her I would wait on an email or court papers.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Read up on your rights here and also make a complaint at this government site:  http://www.consumerfinance.gov/

Also file a complaint with your State Attorney General's office.

Call the place where you KNOW you do owe to confirm the call (which IS NOT official notification of debt).  Then read BigA's post above yours for loads of information.
