- JD| 1 replyThis company has been sending text messages to anyone with the same last name in my small town and has been calling my cell and work number. When I spoke to an agent earlier this week the told me the purpose of the call - I advised them it had been a long disputed item - the agent hung up on me. Today they called my work number and when I call back the agent said how can I help you I advised that they called me and I didn't know what the purpose of the call was - the agent said one moment - I could hear conversations in the background and then the agent hung up on me with no further response.

- BigA replies to AYou will need to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), cease and desist calling, or "not me" letter (this will be the best money that you have ever invested). Also send it first class mail in case no one will sign for it. Make a notation of that fact at the bottom of the letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt, and we would all be the richer for it. It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

They have yet to identify themselves or the purpose for the calls which is also required by law.

- KI first was notified of this number after they called my father and told him that I had a court order and that they needed to serve me papers. I was confused considering I haven’t done anything illegal and have very bills being that I am a college student and my parents take care of me. When I called the number back they asked me to verify MY SOCIAL SECURITY NUMBER and would not tell where they were calling from only that the matter was urgent and their client was taking action. IT IS A SCAM. DO NOT GIVE THEM ANY OF YOUR MONEY.

All they say in the voicemail, as I have the number blocked but they can still leave voicemail, his name is Chris and I am not to ignore this call, he doesn't want to have to file against me, I need to call him back immediately. No company name and nothing about what it's pertaining to and he sounds very threatening. Not appreciating this, my husband just passed in December and I have enough to deal with, without people like this.
