- Ken| 1 replyFolks its a complete scam. First off, any contact made legally must include something in writing telling you you have 30 days to dispute a debt. This is fake, as the number they called from does not exist and the number they tell you to call is not listed. DONT PAY THEM A CENT
- MR| 2 repliesPeople who get this call, don't worry. This is an absolute scam. The FTC is out doing I don't know what but certainly not stopping these criminals from causing heartache. The scammers target people who have or once had financial hardship. Lowest of the low. Unless you have serious money for a lawyer and serious time for the work to sue these people, I suggest that you just don't respond. The best way to stop them is to change your phone number and not use your private number if you need to apply for new credit anywhere but at a reputable bank. Luckily it's pretty easy to change numbers and get secondary phones these days. And it's legal, unlike the character defamation and terroristic threats some of these guys use.

FDCPA lawsuits do not cost you anything until you win because the attorney will take the case on a contingency basis (no money out of your pocket up front), and as far as time, well you don't really need a lot of time to file a lawsuit as the attorney does all the work.Quote:Unless you have serious money for a lawyer and serious time for the work to sue these people,

I've had neither. At first I used to worry about these calls and I actually paid a couple. But I tend to wait now and just see what happens. If it's legit I guess I will get served paperwork. That's honestly the way I have to look at it right now or I just stay worried cuz these calls are so prolific now! These past debt problems are just that, in the past. And since I know I took care of them I need to stop worrying about these calls so that is my advice to any of you that are facing the same issues.

They mention that they have received a Fax document or that some sort of complaint has “come across my desk” and that there is a pending legal matter or action about to filed against you to create the sense of urgency. They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer). They threaten to serve you at home or at work. They tell you that if they serve you at work they need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work. They also tell you that you will need two forms of ID. None of which is true. Process servers do not ever call ahead so that you can dodge them. Process servers get paid to serve papers, nothing else. They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”. Court documents are time sensitive and have to be served within a certain amount of time. Remember that you can always call the local courthouse to see if there is actually a lawsuit that has been filed against you.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter, email, or text (postmarked in the case of a letter) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. Unless they have communicated it to you verbally at the beginning of your conversation. It also must contain the “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this communication must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that communication you should immediately send that debt validation letter by certified, return receipt mail.

- S844-977-0239 called husband's cell from a 616 area code. They stated they were from Richmond mediation services and that there is a "pending civil summons" and to call to "stop action". They also stated that even if there was not a call back it wouldn't stop the litigation process. They used my maiden name from 12+ yrs ago...

The name they used was a name I have not used in a decade.
When I called back in, they would not identify themselves except to say that they were the "mediation department." They kept referring to themselves as RMS, but would not say what it stood for, despite the message they had left saying "Richmond Mediation Services." The address they gave me was fake. I called the building manager for the place they are supposedly leasing and they are not located there. The girl on the phone made several threats that I would be sued etc. Report them to the CFPB!
