- jitter| 2 repliesGot an automated call on my cell phone. Message said something like "We're calling about a recent transaction involving your bank account" and proceeded to give me a "case" number. I declared bankruptcy in 2012 but there have been a few clingers-on trying to scam me into paying some of the payday loans back.
Please remember that chapter 7 bankruptcy discharges debts and makes it illegal for companies to try to collect on them. They only way a discharged debt can be still be paid is if the debtor voluntarily pays it. It is also illegal for these people to pose as lawyers/law enforcement and/or threaten you with arrest or other legal action. If you cannot afford a lawyer, at least report these people to your attorney general.- Caller: ADR Arbitration Group

- CWG40 replies to DoughTotal debt scamming operation. No one can be arrested for being in ordinary civil debt. Cases of fraud are handled by local public prosecutors. Debt collectors have nothing to do with law enforcement and have no influence on it at all. Only a judge or the DMV can suspend DLs. No one's DL can be suspended because of non-payment of a civil debt. This is just an attempt to scare you into paying them something.

BBB has seen a major increase in collection agencies starting business in the Upstate New York area over the past several years. In an effort to keep consumers informed about which collection agencies are operating in accordance with federal and state law, we have asked for specific information from all collection agencies located in our service area, including proof of licensing, bonding, and or registration required by NY state or other governments where the business is located, as well as proof of licensing required by any state in which the business operates. This collection agency has not responded to our requests. BBB advises consumers to be aware of their rights in regard to collections. This includes New York States law prohibiting any collection agency from collecting on Payday loans in the State of New York. The Fair Debt Collection Practices Act (FDCPA) outlines prohibited behavior when attempting to collect a debt, and outlines specific rights for consumers. There are penalties for agencies found in violation of the Act. BBB advises consumers to become familiar with their rights under the Act, which can be found at the Federal Trade Commission’s Website at: ftc.gov . Consumers can file with us at bbb.org/complain.
BBB opened an investigation on the business. BBB found a pattern of the business breaking the rules and regulations of the Fair Debt Collection Practices Act. BBB asked the business to respond to the pattern and asked that the business address how it plans on changing the issues that caused the pattern. BBB has not received any response from the business.

In addition, I suggest people having trouble with these scammers also contact the Consumer Finance Protection Bureau (website: http://www.consumerfinance.gov, phone #: 855-411-2372). They have an address and profile for ADR Arbitration Group.

The Consumer Financial Protection Bureau got no response from ADR Arbitration Group, but when I gave them Delray's info I got a response in about 2 business days saying they were re-calling all collection activity and closing my account. Apparently they buy debt in bulk and divvy it up to various collection agencies (many with questionable practices, it seems).

- DonaldI defaulted on a loan in maybe March and still owed under $250. I was out of work. I was not aware my loan was sold to like 4 different companies. Suddenly, last week I get calls from this attorney, Scott Pope stating if I don't pay what is owed I will be served and have to appear in court and it'll be extremely expensive if I don't just take care of it now. It was a payday loan I honestly forgot about. Like I said, I received no contact. I just don't trust random companies. Do I settle with ADR/Del Ray or just block these numbers and say forget it? I didn't think you could get served for defaulting on a tiny payday loan.

- JasonI got called originally on June 3rd from 844-247-1987. It was made clear it was a scam that day from the sketchy limit of the information they had versus what they were trying to claim. I made it clear I knew what they were up to that day before hanging up. I was pretty much left alone until the last two weeks, and now they are dialing me daily (mon-fri) for the past week from 855-233-5051.
