- ActThis is a legal sounding scammer. They find an old court case with a judgement (typically a creditor you defaulted on). The judgement may or may not have already been settled and it may or may not be valid (mine was settled in 2005, so even if I did not pay it, the judgement is no longer valid). They then say they are serving you papers. The hope is that you will be in so much fear of being sued that you will pay these scammers something. Last time they called me, I got their address so I could “send them a check” then traced that address to a UPS store in Georgia. I then called the store and got their mailbox shut down for them doing illegal activity and notified the county sheriff of what was happening.

- BigA replies to Hoss| 1 replyA bill 8 years old can still be collected on. In some states, not many, you can still be sued. But in any case they must provide you with a dunning letter. If the Statute of Limitations has passed for your state then threatening to sue is illegal.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.
