- Stacy Goodman| 2 repliesI received a phone call from this number today.stating I will be having legal documents delivered to house between 9am -4pm.I asked what it was about.and they gave me a number to call.and a case number to give so that I can find out what it is in reference to. The number they gave me to call was 855 465 0152.I talked to a person name Marie Davis. She said it was for a payday loan from 2011 for 500 dollars but .since it was never payed .I owe 1589.28 cents.but they will settle for a one time settlement of 621.88...Should I be worried about this.

The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:
Unless the original communication contained this specific information, every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money. ["Written" means snailmailed - US Mail ... not emailed or texted]

Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via Green Dot, MoneyGram, Western Union, prepaid gift card or other untraceable means, then the call is definitely not legitimate.
REMEMBER THIS IF YOU FORGET ALL ELSE:
1. Legally, THEY must prove you owe the debt (you do not have to prove to them that you do not owe the debt)
2. They must prove they have a legal right to collect the debt
3. They must send you snailmail with specific info within 5 days of the original contact, if you request that validation, or if that information was not provided on initial contact. You have up to 30 days to reply to that validation.

Please reply to this post, to let us know you read it, or have taken suitable actions to protect yourself. - LynneGot a call from Scott Wilson with the Civil Procedure Division and wanted to let me know that he would be coming out tomorrow to serve legal documents. Number called from 469-646-4701 but told me to call 855-332-0410. Claims to be located in Memphis TN. Soooooooo tired of scammers!!!

- David replies to Stacy GoodmanNo, do not worry about it. Regardless of what they say, they are just sleazy collection agencies. Even if the money they say you owe is legitimate, payday loans DO NOT show up on your credit reports.
What they are doing is trying to scare you into paying them by using legal jargon such as 'you're going to be served with documents' or 'a process server' will be coming out to deliver docs to you, etc, etc. Some will even go so far as threaten you with legal action or arrest; which is a violation of the FDCPA and they can be sued for doing so.
Just ignore the calls. It may take a while but eventually they will stop....
(One more thing..after awhile of not getting any calls, they may start back up again this time from a different collection agency but still using the same tactics. Again just ignore them as well.
