    States they had a summons for a debt about to be served on my husband. Refused to provide proper paperwork. Called the sheriffs office who checked their records, checked with the constable’s office, and checked the county filing record finding NOTHING with my husbands name on it. They attempted to get us to pay $1150 or be served for a court case. Sheriffs office said it was most likely a scam, these companies are hijacking local phone numbers to get money by scaring people. He stated that even if they did acquire the debt from original company we owed they cannot legally ask us for money in the state of Texas. So this is most likely a scam but could just be illegal actions by a debt collector.

    $300 dollars is not lot considering how this scam works.  If you paid by credit/debit card you should be on the phone to your bank right now disputing the charge.  You should also know that you are now considered an easy mark by extortionists and they will call again and again and will sell your information to other crooks to call you as well.  You should be taking the time to learn and educate yourself so that you do not repeatedly have to put "crime victim" behind your name.  Start here:

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
