- michelle replies to Laura W.| 1 replyYes, I just received a call today, and also my mom, stating I have a pending law suit from a Hospital bill from 2004, I have never been in a hospital, when I asked to provide me with information regarding the bill, told me they could not release that information for privacy act, and told me they will see me in court.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/
Also file a complaint with your State Attorney General's office.

- HThis # called both of my in laws today and asked for me by my maiden name. They told them that they were with m&a law firm, left a case # & phone# but would give no other information.

Yesterday, my wife received a phone call from her ex-husband saying he and his father had been contacted by a law firm saying they need to urgently talk to my wife regarding a legal issue. When my wife called them at the number they provided (855-413-3983), they said they were Millstein and Associates Law Firm in CA. This law firm does exist but does not have the same contact number listed on their website. They said they had to look up my wife's case and said they couldn't find so could they have her SSN. Unfortunately, my wife gave it to them and then said okay here it is. They told my wife she owed a past medical bill from 2006. If she didn't pay it immediately, she would have to go to court. We got them to give us the name of the medical facility that they said she owed money to, and when we called the medical facility they stated they had no record of any past bills owed. Obviously, this was appears to be a scam and used the tactics of contacting her friends/family first to put pressure on her because it seemed urgent, followed up my using a real law firm to sound legitimate, using the pay now or else threat of going to court, and finally by saying they couldn't locate my wife's case as a way to get my wife's SSN. We are going to freeze her credit, so hopefully that will at least protect her a little bit.

What joke. I cannot believe these losers who prey on the elderly. Eat sh&? and go to H#ll, Mark!
