- Tara G| 3 repliesThis is the number associated with the firm that is currently taking money ($289 from my $600 check) from my paycheck weekly without my approval. When I called them to confront them, they forwarded me over to Bexar County Clerks Office, which is the county that I live in, and apparently I had a judgement placed against me for an amount of $6089, but the county clerk could only give me their info, not WHY. When I called them back, I found out it was for a loan that I took out for $750 3 YEARS AGO! They claimed they tried getting a hold of me to clear this up, but couldnt? I have lived in the same spot for 7 years...... Its total BS. DONT EVER BORROW FROM PAY DAY LOAN!

Call Bexar county independently, google the number and call them.
If a judgement were issued against you, you would have PILES AND PILES of paper work prior to the company taking you to court. In the form of the legally required debt validation and late payment notices.
You also have to be served my a representative of the court. You'd know if you were served or not.
Can you give us the name o the company that took you to court, along with the address?

They told me I would have to go down there with gov issued ID to get a copy of the docket since I have no info on it at all. They also said something about a motion that I could file to bring the case back to court, and I can defend myself. But, IF i took the loan out at the place specified, I WOULD have needed to place ID on file. I dont mind paying what I owe, but not 10 times the amount. Any help on THAT would be great.

There's not a whole ton that anyone can do until you know WHO is taking money from your check.
Your company HR would have to have the judgement, too, if they are deducting money from your paycheck.
There are also laws on how much in fees companies can tack on (it's in the link I included)
In Texas, to serve someone (which is law) you have to either hand it to them, or have it delivered via certified mail (which required a signature on your behalf) if that part (or any part) of your due process was violated, you have a case.
You can google consumers rights attorneys in your area (and probably find some pro-bono...free...ones who will accept the case) since this is a pretty clear miscarriage of justice.
