- Tony| 1 replyReceived a blocked call stating to call the above number by 24hr or litigation would proceed . When called I was told if I didn't pay with 15 minutes then I'd be served papers and there would be a judgment against me for double the amount . They claimed to be a law firm . I told them to just serve me . I'm sure if it was legitimate I wouldn't be given any warning just a knock on the door .. Anyone ??

- BigA replies to emilyThere is no need for you to call anyone. First, they cannot "file a judgement". They have to properly serve you, go to court, win their case, and then they get a judgement. Now, it is up to them to prove that you owe the debt, and that they have the legal right to collect it. They do that by starting out with this letter, that is mandated by law:
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
It appears you are unsure as to how debt collection is supposed to work, so why not learn what you need to know and while you are there, file reports of this criminal activity:
Read up on your rights here and also make a complaint at this government site: http://www.consumerfinance.gov/

I asked for a statement and he said no. I asked for details and he gave me nothing but RUDENESS and threats. The last thing that was said was " Have a nice day and good luck in court". This is a true issue and I want to go after them. (Garrison Acq Group) I also would like to find out who got hacked that they were able to obtain my name, address, and a date that I was in the hospital. I hate to think that my information is out there.
