    Another call about a "legal matter" - Voice Message:
    Ah Yes This message is for XXXXX XXXX I'm calling on behalf of county document services, and the reason for my call is my department is trying to deliver legal documents for XXXX XXXXX to appear in court.  The documents were returned from the address we have on file off of [My street].  So to avoid further legal action you must contact Peterson at 855-963-1625 when calling reference case number XXXXXXX.

    Private Caller on my Caller ID, doesn't leave her name or the attorney's name. Said legal documents to appear in court couldn't be delivered, and must contact the attorney's office at 855-963-1625. No reason for legal documents to be sent to me, and if they were legit they would be able to deliver them just fine by mailing them to me.

    The fake process server extortion attempt usually consists of the following:

    They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work then they will need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and must be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there really is a lawsuit that has been filed against you.

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

    Company called me, threatening a lawsuit against me for a credit card that was charged off in 2008. When I pressed for further details, and advised them that they were past the statute of limitations, they talked over me, and hung up.

    Called twice from unknown number and left two separate voicemails with two different names. Same story, process server telling me they tried to serve me this morning but that I must have forgotten they were coming. Told me they were serving on behalf of Michael Green, the attorney. Left same number. Said the collection company was EDS

    Left a message basically the same as above saying that they were trying to serve me with the pending legal manner I need to call they gave me a reference number but no specific information and no attorney’s name. Definitely some type of suspicious Spam call Trying to obtain information.

    The person who answered the phone when I called (they had my name and phone) was very rude and nasty. Finally they wanted to confirm the last four digits of my ss#  which they had. I hung up at that point. I should  have checked here first before calling.

    They left a message on motherinlaw phone saying they were unable to deliver papers and they were the county server and left a number for me to call them to make arrangements to get them.They gave a name of attorney and case Number..Have No Clue

    They said it was a legal matter then asked me to confirm last of my SSN which they had.I told them that I was contacting  the county directly and hang up.They are still calling me every day

    Definitely scammers. First they sent me 2 text messages. 1st one was " Please reply YES or Y to receive updates from GIF. 1 msg/day. Msg & data rates may apply. Reply HELP for help. getitfree.us/smsinfo"   The Second text was"t " Then I received a phone call an hour later. They disconnected the call when I asked them what company they were with.
