    DONT BE INTIMIDATED! SCAM
a Joshua Miller called me looking for my husband. Said he was a process server for the county and was unable to contact my husband and needed him to call immediately that they were now calling family. And if summons was served lawsuit wold be filed and charges for avoiding being served. Before I had got home, they were able to reach husband by phone, same Joshua Miller told my husband 'consider yourself served. This was trying to collect a debt we have no knowledge of wanted 165.00 a month payments for a year or 700 now to settle. wanted are bank account number or cc number to set up payments. husband said we would call back. my husband called back to verify law firm name and it was Grey Lay Firm. Husband told guy on phone he wanted to make sure it was a legitimate law firm. Man on phone says "well you asked the wrong question" husband said what question should i have asked he said you will figure it out and hung up. I followed that call with a call directly to an attorney friend. said get all the info i can, names and such if they call back and to give them his law office number and tell them my attorney is on notice and all further communication should be done through them. My attorney stated that just in the 2 phone calls to me and my husband at least 4 violations of the Federal Collection Act and even if a debt was owed, it is nothing compared to the issues this company will face with their violations. Remember....a summons is served IN PERSON to you or a member of your family....they dont call!

This company contacted at least 4 family members stating that they were trying to reach me to serve a summons.  They called my number and left a message.  I called back and they asked for confirmation of the last 4 digits of my SS#.  I did not affirm what they had.  He asked my BD and it was wrong so I said yes that's my BD.  They then asked they were calling for  but never asking who I was.  Proceeded to say that they were from Grey (Gray) Law and was calling about a debt (close to $1000) from 2010.  Said the debt  be settled and they would submit a receipt of release.  After I made several inquiries of him (Dan Walker) about the specifics of the debt he was not happy and asked if I cared about going to court to pay more.  Needless to say, I did not comply to his request.

One of the tricks they use is to call your family, friends, neighbors and/or places of employment (past or present or both) to create panic and embarrassment so that their intended victim calls them and they can scare that person into paying their extortion money.  They often call people that have never even been associated with you because they get erroneous information off of the internet.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

Also file a complaint with your State Attorney General's office.
