- Brian| 2 repliesI got an automated message from 855-984-4487 saying that they have a judgement against me and that I will be entered into check systems and will try to garnish my wages. Can someone tell me who this phone number belongs too?
- BigA replies to BrianI cannot fathom how check systems figure into this but this is simply an debt collection extortion scam. In order to get a judgement, they have to go to court. So it is a simple matter to call your local courthouse and ask if their are any cases or judgements with your name listed as the Defendant.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

- KAI got the same call from them threatening me of some thing I owe on my voice mail. I've been getting this call almost everyday but I never pick up. They've been using different numbers with area code 855.

I’ve never heard of being notified 10 days prior to a judgement letter being issued that i should expect a judgment letter.

If a complaint is filed in small claims court, the court will probably notify either by certified mail or personal service (since I don't know the laws in every state, this is a generalization). They set a court date. If you do not show up, then the Plaintiff gets a default judgement. If you do show up, you argue your case. Either way, you will probably then be notified by the court about the disposition of the case. That would be the judgement. You don't get called ahead of time that one will be issued. I would suggest that you read my other post. I would also suggest that you call your local courthouse and small claims court and ask if your name has been listed as Defendant in any civil proceedings or if any judgements have been issued against you.
- RosI rec'd a call from this Harvey Ross, KKH Assoc stating there has been a formal complaint attached to( previous last name) and SS# and that the complaint is set to go out of their office on April 6th 2018 either to my home address or last place of employment. I just listened to the message as my phone was messed up and the call itself actually came in 4 days after the supposed complaint was to go out. He said if I had any questions or concerns to call the number. I'm not dumb

Now received a call from a lady stating she has a legal document I need to sign and I need to be home so I can sign.. think it’s a scam.. kinda trippy they have all my info. Not sure what do.. did call the credit card company they gave me the name of the company which they sent my debt too tried calling them to see if this harvy Ross worked for them.. called for a week straight always no answer and no room for voicemails to be left... not sure what to do..

- VanessaI rcvd a voicmail claiming to be a courier and that she was going to be at my house the next day between 12-2 and if I had any questions or concerns to call the filing company with was KKH & Associates phone #888-345-9717 when I called it went to a voicemail I left a voicemail and the next day (today) they called me back they said I owed money to Victoria secret and needed to pay or else they will go to court they had all my information but when I started questioning them asking for their website address FEIN number they hung up on me
