    No, they don't. And, the fact that they have sued for FDCPA, FCRA and TCPA violations does not seem to faze them, either.

    Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.  

    Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

    This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

    David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

    [The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

    Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.  

    So what can you do if you receive "wrong number" calls from debt collectors?

    1. Sign up for the Do-Not-Call registry.
    2. Save the calls captured by your voice mail or answering machine.
    3. Contact a consumer lawyer.

    I keep getting calls from these people from different numbers and "unavailable" as well.  I guess they are much like CRA (Capital Recovery Associates) in their collection tactics in trying to collect on stuff that is not valid. Either old debts the original creditor has dismissed, debts past the state's statue of limitations, or time-barred debts. DO NOT talk to these people or give them information. Keep all calls documented, file a complaint with the FTC (Federal Trade Commission) at http://www.ftc.gov and/or FCC (Federal Communications Commission at http://www.fcc.gov whichever applies. There are documented cases where they are in violation of FDCPA (Fair Debt Collection Practices Act), TCPA (Telephone Consumer Protection Act of 1991) and/or FCRA (Fair Credit Reporting Act).

    These guys started calling me out of the blue claiming that I owed a certain creditor.  It was an old balance on a credit card I had several years ago and had paid off the balance.  NO money was even owed!!!  Just a bunch of sleazy jerks hoping to dupe me into paying them some money out of ignorance or intimidation.

    I am receiving collection calls from this company for my ex-husband, with whom I have not had any contact in the 15 years since we divorced. I told them this number is not his, nor has he ever held this number or been reachable at it, but they remained insistent that I provide another number for him, saying "but you know him" as if that was some sort of guilty-by-association admission. I have no way of reaching him but they keep insisting I do and keep on calling, despite my warnings of harassment. What can I do to rectify this blatant disregard for my privacy?

    You can hire an attorney and sue them or report to the Internet Crime Complaint Center http://www.ic3.gov/complaint/default.aspx , the Federal Communications Commission http://esupport.fcc.gov/complaints.htm , the Federal Trade Commission https://www.ftccomplaintassistant.gov/ and your state AG, as appropriate.

    Got a call from NOC Financial Systems Inc.   Who.....????  They let me know that they have been authorized by Citibank to collect of their behalf.  I let them know that if I could not pay Citibank, what makes you think that I can pay them!  Once I lost my job, the banks started "tripping" with my interest rates.  Rates went up "sky high" AND interest and fees SKYROCKETED!  I let them know, ok you guys there goes my credit rating and stopped making payments on EVERYTHING that had to do with a credit card.  Now, I have money in the bank to take those clowns out of the loop.  These knuckheads get bailed out when they make bad decisions.  Ok, I lost my job!  Unless they are calling about a job offer, they are wasting breath!  The BANKS turned off the credit, I turned off the PAYMENTS.  Want to change the world, change yourself and your world changes around you!

    Received a recorded message from a "Florence Bruno" on an attempt to collect on a debt.  She left a file # and asked that I call back.  Well, I called the # back and it was for the office of Geoffrey Price.  So...I told him not to call me.  I told him I am not (insert names of people that I mistakenly get called for all the time) and left him the file # and my phone #.  Told his machine to stop contacting my home in an attempt to contact two individuals who I do not know.
