- Yajaira| 2 repliesSame experience than other a lady call speaks in Spanish, she mentioned the last 4 digit of my social security and she asked me is the 4 digits are the right one just to make sure she is speaking with the right person. She said I owed 2800 to sprint that they sent to collection but know is not more on collection now is on arbitrage and I have to pay $1450 before they take action and send me to judgment. If I don't the judge is going to send me to jail for 10 years. I told her to call me later because I am going to verify first about that debt and she said ok I put a note in the system.

- BigA replies to YajairaNothing to verify. No one goes to jail because they did not pay a bill, and certainly not for 10 years, that is simply ridiculous.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

List of State AG’s offices: https://800notes.com/faq/attorney-general - MyrnaSame thing with Yajaira there was a lady calling me from this # 917-231-2693 in spanish and ask for my name and I said it was me and she said there is a complain against me and if is not taken care they are going to take me to the court so she said to call this number 866-217-8947 and she even gave me a case # so I called and a guy answered arbritation...dept I said I am calling because I got a call saying that there is a complain against me and I got a case# so he said oh give me the case# so I gave him the # and he said you are Myrna ......mentined my last name that's you I said yes he said oh the federal law requires me to verify your information so can you give me you birthday why I need to give you what about if you are those people that just steal information and he said we have your birthday we just need to confirm the date so I told him no and I hang up on him so now I blocked these numbers thank you Yajaira for let us know that is a scam this people

- Lisa replies to YajairaSame thing here, except it’s a debt from 14 years ago for Verizon for an address I never lived at. Didn’t threaten jail, but did threaten judgement. Mark wouldn’t let me talk , caused me to get very nasty with him. Told him to stop calling my phone and harassing me and threatening me.

I returned the call when my wife told me to. The lady that answered the phone was in nearby Delaware. I asked her to identify herself, her agency, and she raised her voice and told me she would be asking the questions. I asked "is this a criminal matter?", she said "..no....", I then asked her "are you law enforcement?", and she again raised her voice, and yelled at me "are YOU law enforcement!??!!". I asked who she was, she said the name of her company was a "trace locate" company, and thats all she would tell me. I was given a number for the people tracing me, and I called them, at the number 866-217-8947. A lady answered and I asked who they were, and what their business was with "tracing" me. She began talking rough and I asked her also; "is this a criminal matter and or are you law enforcement?". She said no. She asked me for my social security number and I said "first let me identify who you are since I do not pass out my credentials to strangers". She tried to ask for my SS# again, and I calmly asked again, "who are you?". She very quickly mumbled "sumfurt n sims" it sounded like, and again asked ny SS#. It was obvious she was hiding who she was, so red flags went up on my end. I politely asked not twice, not three, but four times...she irrationally accused me of yelling and I said "please SPELL your agencies name so I know who I am talking to.". The lady yelled again "are you stupid!? STUMFERT AND SIMS!!". I said calmly, again (as I knew at this point she violated legal procedures and or was a scammer". She finally spelled out Stanford, confirming it was "STANFORD Associated". At that point I said "thank you for that. Now what is your business with me, mam?". The lady then said "this call is over!!! Good bye!" and abruptly hung up. Highly unusual. Highly unethical. Pretty sure illegal as all heck.

- Chass11 replies to RyanMy wife had the same calls! After her and I getting about a dozen we called the 8662178947 number! Gave the person the so called case number! We told her if she had the information like she said, then mail us the complaint! She abruptly hung up!
