They say they are going to file a lawsuit against me. I tried looking up their phone number and a website, but nothing could be found.

- PrivateI received a call for someone else from Dillard Asset Management, Ms Boehm saying the same thing that a lawsuit and summons was pending my statement. She gave me all of this guys info too and at the end of the message said, you have been notified. Is that legal? I do know who they are looking for but its not me. I cannot find anything about this company anywhere.

If they call again, deny any debt, then demand total validation of the original debt, including name of original owner and amount, a copy of any signed contract that may exist with the original owner of the debt, and a complete record of the alleged debt with history of any payments and last activity occuring on the account. Tell them they have 5 days by law.
If they refuse for any reason or claim that they have already sent it, or that they don't have to, they are a scam. Until properly validated to your satisfaction, you don't owe them a thing. File a dispute with your bank regarding any money removed without your authorization.
- Worried| 1 replySo I got a call from Mr. Kay stating that I took out a loan 8 years ago, that I am being sued for writing a bad check and never paying the payday loan co. They said I borrowed 250 and now owe 3500 plus the IRS will be after me because I did not report the 250.00 as earnings. When I began to ask questions he said "Oh your gonna argue and not listen, fine I was gonna make you an offer to settle but never mind." Another person then got on the phone, and was very calm. I told her I had no idea what she was talking about. She said I was being served papers in the next 24 hours unless I paid them for something I borrowed years ago. She gave me a weird address that I supposedly used to take out the loan. I asked her to mail me some information. She said that it needs settled in the next 24 hours so she could email me. I am waiting for an email. I am seeing all of these comments on here but nothing about what happened to all of you later or responses in fact. I am hoping once I post this message I will be able to read responses.

- Gunnar replies to WorriedFirst, an e-mail is not validation..of anything. Demand proof of their claim be mailed to you. Not e-mail or fax. She refuses, she's scamming you.
Second, check your states statute of limitations regarding debt. 8yrs. is out of SOL in almost all states.
Third, if you were to be srved with any legal papers, they would not give you advance warning.
Educate yourself as to your rights under the FDCPA. This woman is in violation of federal regulations. Tell her that you're aware of your rights and that any further calls will be recorded and handed over to your Atty.

Gunnar - Jean replies to Paramount LawUnfortunately, I gave Mr. Kay (as he seems to like to call himself) my Paypal Debit Card information to pay the money that I supposedly owed (after he negotiated with the people who were just about to serve me that is) and when I called Paypal to ask them to stop the payment after reading up about what these companies can and cannot do, they said that they couldn't stop the payment but that I could file a disputed transaction as soon as the company completed it. Which of course they did.
The money was taken out by a group called Barclaire Management out of Buffalo, NY but when I received the email from the "settlement director" is was from Delaware Asset Management who is apparently the real group behind all of this. Like the person below me, they threatened me with bad check charges, garnishment of wages, reporting the "income" to the IRS, etc., etc. Obviously they scared the beejeebers out of me or I would have never given them the debit card number.
At this point, in order to process the disputed transaction, I have to call them back and try to "resolve" the issue and I'm sure that's just going to be great fun if I can even get someone to talk to me. Should I tell them that upon further investigation I found out that what they were doing was illegal and that they couldn't threaten me with everything that they did?
I'm not arguing that I did take out a payday loan however, I paid back the initial amount plus a crapload of interest before I stopped paying as I found out that in the state where I live (CT), payday loans are illegal to begin with and that they couldn't charge more than 18% interest on a loan. Technically because I had paid the original amount of the loan and interest, I really didn't owe them anything more. The loan was taken out in 2008 yet this guy was telling me I was going to have to pay almost five times more than what the loan was originally for.
So ... any words of advice as I try to fight this? I'm sure they're going to say, "You paid us already" and hang up on me but do you think that will be enough for the transaction dispute? - Sally| 2 repliesI used to work with Mr.Kay & he was actually by the book & #1 in our office.he was friends with my ex .he was my team leader, very positive, great Guy & payday loan is wired into ur checking account. If it bounces as a debit, it's still a bounced check electronic transaction & they give u to check systems.that's what happened to my roommate & if u print an email it's the same as a faxed letter. Duh!

Your "loan-to-check" routine has been exposed here a thousand times and you've just proven, yet again, what we here have known all along. That you are a FRAUD, a LIAR and a really lousy SHILL!
Your lame and illiterate reference to e-mails and fax. shows that your comprehension is sorely lacking as well. I'll make it more plain for you. An e-mail or a fax. is NOT admissable in any court as proof of ANYTHING! If you don't receive it in the mail, it means NOTHING! "Duh!"
Lastly, if your loan offer requires ANY funds up front, in ANY form, it is FRAUD! ALWAYS! NO EXCEPTIONS! EVER!
Now scuttle back to work Fraud-Boy! One of the other call-center maggots is trying to steal your chair!

- SuspiciousI received a message on my cell phone from someone named Lisa Cobb or Cop. She left no name of the company she is working for, and the message was for my daughter. She claims my daughter has two fraudulent cases against her and that her or a Juan Beltran or their attorney should contact her immediately. And she left a case number. She said she is going to try to get to the bottom of this and if my daughter didn't call before the end of the day she would hand over the case to the DA office and my daughter would be subpoena to appear in court. At the end of the message she says you have been notified. I called her back and left her a message telling her this call is suspicious and doesn't make sense. Why are we hearing of this for the first time. And where are you calling from exactly you did not leave that information. And I said why has my daughter not been notified by the authorities or a detective or anybody about this. My daughter does not have any cases against her and she does not have a criminal background. I need you to call me back ASAP and I did leave on the message that I myself work for law enforcement and I will get to the bottom of this myself. People watch out for this phone number 866-226-1909.
- whosurgalThese people call me all the time from this number. Never leaves a name, what company I am suppose to talk to. He leaves threats, telling me I am going to be sued. He is going to serve me papers for court. This has to do with a bad check. I have been with the same back for years. They just need to leave me alone.
