    Have just gotten threatening phone call from them. Said they are not a debt collector, but it results from a loan that I thought my consolidation firm was handling. They are talking lawsuit and garnishment, etc. Are they legit? It is a internet payday loan originally. I am in California.

    No, they are not legitimate. Even if the debt were real, threats of this nature almost always indicate it is a bogus or fraudulent debt collector engaged in illegal tactics to collect a nonexistent or invalid debt. Demand a full, complete and legitimate letter of validation be delivered to you by mail. Not e-mail or fax. As outlined and required by federal law. Give them no information. If they are legit; they already have it. Confirm nothing.
    Google the FDCPA and visit the FTCs website. Know your rights.

    They are most certainly legit, I contacted my original creditor told me that there firm was handling this I was able take care before it went any further. I received confirmation of this..

    For the last three day my wife and family have been getting  calls from this so called not collection agents by the name of Nation Wide Litigation  Firm. I talked to them yesturday 4-30-3013 and again today 5-1-2013. they told me that I need to pay them by credit card, debt card or pre-paid card only or they will take me to court.  When I asked for the corpertate office address and phone number they said all they can tell me is there in California. I talked to a representative by the name of John @ 866-400-3784 ext 330. John said they had a field agent looking for me his name is Ben White @ 928-247-6470. On 4-29-13 Nation Wide   called my work and informed then that I was going to be serve and garnish  my wages. that night or the following morning. It never happen instead they starting calling thoughtout next the day telling me I needed to pay this debt. When I talk to the representative today and yesterday they told me they have no control over the field agent but they were trying to set up a payment plan for me. If  I could make payment this fri  they could   call off the agent. . Now if this is a real company wouldn't they take anytype of payment, I offered a money order or cashier check. The representative said debt, credit or pre-pay only. The amount they say I owe is 5 times more that the amount I borrowed. When  the loan in question was taken out both my wife and I are on the paper work but yet they won't talk with my wife only me because they say she isn't on the loan.
     This early a.m. Ben White called and left a message that I needed  to call him with my physical address information so he can serve me. My address is on the loan paper that they said they are collecting for. I feel this is a scam as I never  recieved anything in the mail, e-mail , phone call or tex-message from the company we took the loan from and NationWide can't give me any information about the loan other than the name of the company. Any advice will be helpful and greatly appreciated.

    Well, bully for you!  Legitimate debt collectors do not threaten or harass people - they follow the provisions set forth in the FDCPA.

    They are scammers!  Let them know you've reported them to the FTC, the Attorney General of your state and also the FBI.  If you are threatened with garnishment of wages, then they are definitely scammers because they would need to take you to court to be able to do this.  So if you haven't received full debt validation showing original creditor, amount you owed, last date paid, etc, they are bogus!  If you were being taken to court, you would also receive paperwork from the local court.  You can call your local courts to see if anything is pending there for you, but I can 100% guarantee you that there is no court date listed!

    Scared about Litigation....

    They called me to day saying they were going to come serve me at work. Also call my HR department and told them they were going to serve me.  He said he would be here in 20 min. From all I am reading, it is a scam?? If they have filed paperwork with the courts, wouldn't I see it on our Wisconsin Circuit Court?
    This was for a payday loan for American Web Loan, which I took out a $500 - loan.  Did not read the fine print, and they would take out $400 every two weeks and that did not GO towards the balance.  And if I wanted to pay it off, I would have to pay the $400+$500 = $900.  This went on for about 3 months and could not afford to do this.  I closed my checking and then reopened a new one.  They say there are serving me papers for Fraud.  I am pretty nervous right now and embarrassed they are calling my HR department.  ANY info would be great.....Their phone #855-772-0149  When I call the server's number back, it is busy... 414-375-2603 - we have caller ID at work.

    UPDATE: They never showed up.  It has been over 2 hours since he said he would be here in 20 min. Nothing, no call - nothing. When I try to call  number back....it is busy. I will be filing a report with anyone who will listen to me. This is nuts they can put people in fear!
