Scammer making threats if you don’t give them your personal info!

Called and stated I owed medical bills for a visit that never happened and said they were calling from Schmidt and Associates a law firm that I was being sued by unless I pay the amount mentioned. Ensured that I did not owe anything directly from the medical providers.

Got a call from "Scmidt & Assoc" saying I needed to be home to sign for a document between 8am - noon on Wed. It references a file # and calls me my maiden name. At first, I thought it might be real because my husband just passed, but he always taught me to double check stuff like that. I'm glad I did. Probably a scam.

I received the same call just minutes ago.

Just received similar call but for my son who hasn't lived here for 10 yrs. - said it was 'firing agency'  - didn't answer but that was the message sent. Let them come over... Ha

Just got the same call. Automated about being home to sign for documents. When I called she put me on hold to speak to a Mark Hernandez. While on hold I saw these posts. I hung up!

I received a call from this number today on both my house and cell phone claiming that I owe some type of debt and to give them a call, they also mentioned serving papers next week. Good thing I know I don’t owe anybody anything. They also used my maiden name in the recording.

The fake process server/location finder extortion attempt usually consists of the following:

They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work then they will need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and must be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there really is a lawsuit that has been filed against you.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

Called me, about a family member, stating he would need to sign legal papers about a civil suit Wed between 8&12. Said can’t give any information. I informed her he doesn’t live here. Told me to have the family member call them at Schmidt & Associates. Then hung up on me.

Got a call on my cell phone for my son, no idea how they got my new cell number. They left recording saying the same as what the other people on here posted. I didn't call answer, I didn't call back. I Google and saw that it is a scam. Do not call these people back!

Called my sister's cell phone. How they got this number - I do not know. She does not have the same last name & she lives 3 hours away. Here is the recorded message: "This message is for ********* ******, we have documents being delivered that require your signature between the hours of 8 am and 12 pm, next Wednesday. If you have any questions, regarding the information being issued, please contact the filing agency Schmidt & Associates, at 866-611-6714, and reference file # *******. If there is no call back within a 24 hour time period, we will deem the address verified and the information will be issued. Thank you for your attention to this urgent matter."
I have not and will not call them to verify!

Left a voice mail from Schmidt & Associates that my mother was to receive docs next Wednesday and left a case number. I called them back from a land line and spoke to someone who said my mother had to call and ask for Mark Hernandez. When I asked why my number was called they said she had not called them back. My mother never received any calls from them at all.  THIS IS A HUGE SCAM!!!!!

I been getting the same call for 3 weeks now. My caller ID on my cell says  scam. The call is a automated message telling me to be home to sign for documents on Wednesday. Today they called my X husband  and left a message with my name. WTH I have been divorced for over 20 years. I told him its a scam do not call them.

They just called me looking for my ex husbands ex wife... How they got my number i don't know... I have been divorced for 26 years....been remarried for 23 yrs.   I said i didn't know anything about her or her where abouts...he started yelling, screaming at me calling me everything but white.... I don't need this scamminy harassment...

These people are scammers! They lie ! Funny how no one has gotten anything from them and its all the same ! Its scammers

Called about my brother. Not sure how they got my number, or knew his name. But it was Schmidt and Assoc. I've never heard this one, and thought it might have some legitimacy for a split second.

I just received a call from this #, I wish they would show up at my house. It will be real interesting when they piss heir pants.

Same experience as others here. Called my cell phone and left same recording. They were using my correct last name but wrong first name. I called the 866 # on caller ID and a women answered. I didn’t catch the case# from voicemail they left but she could pull my file using my cell #. I asked how they got my private # and she wouldn’t answer but repeated the case # again and said it was something being handled by attorney Mark Hernandez from law firm in TX. I asked her to verify if they were mistaken because they had my first name wrong. She was quite abrupt with not much more to say and hung up on me.

I just received the call from this scam people 20 minutes ago from this phone number 1 866 611 6714
