    They left me a voice message on a 'family members phone' stating that I had a claim brought against me. They said they need my home AND employer information so I can receive the "official" paperwork. If it was official they would have MY correct information. Therefore, this is just another scam.

    I received a call today from (412) 879-0926...I don't answer numbers I don't know. I listened to the voicemail and it was some lady named Susan giving me a claim number telling me to call the firm handling it. That number was 866-844-8138. She mentioned something about a locator to try to find my residence or place of employment to serve me papers. Not only did she call me, but she called my parents as well. I blocked my number and called the 866 number just a little bit ago and it went right to a voicemail for Nationwide the desk of Nathan Summers. This isn't my first rodeo with these types of calls and I know the law well enough...all debt collectors are supposed to send you proof of debt...these people haven't sent me anything. They can claim they don't know where I live all they want, but if they have my cell phone number, they surely have my address!

    No it's not.  Total scam.  Don't give them any information and don't send them any money.

    Most likely an abusive debt collector.

    I received a call yesterday as well, here is the thing I figured a scam because if it really is a process server they won't call you to let you know that they are coming to deliver papers to you, they get this information and verify it, then if a law firm or collection agency is serving you with papers or garnishment or something they would appear at either your home or serve to your employer.  The question is how do we get rid of these people?  How can they not be caught and get out of our lives????  They also don't identify themselves which if they were legitimate they would.

    The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

    •is seeking payment on a debt for a loan you do not recognize;
    •refuses to give you a mailing address or phone number;
    •asks you for personal financial or sensitive information; or
    •exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

    If you think that a caller may be a fake debt collector:

    •Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
    If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.•Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
    •Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
    •Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
    •Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

    Do NOT give them any information or offer to settle any debt even if you did take a loan from one of the companies they are representing.  The State of Oregon Finance dept told me that the company I was involved with (HUSKHAWK), has no license to do business in my state, are in violation of many laws, etc.  Told me to close my accounts so they can't take any more money from me, etc.  I did that.  2 years ago.  Now today they resurfaced, called my HR dept.  They called me and said they would be there within the hour to serve me papers for fraud.  I told them I'd be happy to accept the papers and to go ahead and come on over and all the expenses they incur in trying to collect on a debt that was illegally paid many times over would be going down the toilet when i see them in front of a judge.  Their only response was... "would you like to take care of this today by making a payment?"    It is VERY likely that the company who is hounding you has no legal right to do so and in some cases may have even received a cease and desist letter from your state for any and all collection activity.  Most states have a website where you can check to see if a company has the right to do business in your state.  Check with them, but my advice is... never give them your debit/cc number and if you already have, close the account. (and apologize to your HR manager for the inconvenience :)  )
