To Whom it may concern:
Under The Telephone Consumer Protection Act of 1991 (TCPA). And in repeated violations of this and the National Do No Call Registry. Your company continues to call my residence after repeated requests to have the phone number removed from your call list and a cessation of all calls. I am notfiying you that,
The TCPA prohibits making a "telephone call to any residential telephone line using an artificial or prerecorded voice to deliver a [commercial advertising] message without the prior express consent of the called party," 47 U.S.C. § 227(b)(1)(B), with limited exceptions applicable to non-profit entities. In addition, the FCC has issued regulations interpreting the TCPA. Those regulations require pre-recorded messages to "(1) [a]t the beginning of the message, state clearly the identity of the business, individual, or other entity initiating the call, and (2) [d]uring or after the message, state clearly the telephone number (other than that of the autodialer or prerecorded message player which placed the call) or address of such business, other entity, or individual" (47 C.F.R. § 64.1200(d))
Your system failed to identify your company and your company called me without any prior consent recieved from me. The TCPA gives me the right to sue if your company continues to calls us in violation of these statutory or regulatory restrictions:
A person or entity may, if otherwise permitted by the laws or rules of court of a State, bring in an appropriate court of that State-- (A) an action based on a violation of this subsection or the regulations prescribed under this subsection to enjoin such violation, (B) an action to recover for actual monetary loss from such a violation, or to receive $500 in damages for each such violation, whichever is greater, or (C) both such actions.
If the court finds that the defendant willfully or knowingly violated this subsection or the regulations prescribed under this subsection, the court may, in its discretion, increase the amount of the award to an amount equal to not more than 3 times the amount available under subparagraph (B) of this paragraph.
Just to let you know the counts stand at three (3) violations which so far is $1500.00 not to mention the fines that can be levied against your company by the FCC, NDNCR and the FTC under these statutes. I have found many people online who are receiving these calls from your company. I am going to post information about your company and the means to contact me with regards to how they can file suit against your company under this law and for the possiblities of establishing a precident for a Class Action suit against your company.
I would suggest you contact your solicitors and determine what course of action can be prepared to defend against these charges or change your business practices and discontinue calling people illegally.

BALANCES FOR CREDIT WENT TO $0.00 BUT REMAINING BALANCES VS. AMT. OF CREDIT DOES CAUSE 'RED FLAG' TO SHOW UP AND LOWER CREDIT SCORES.
I PAID THEM OFF TO A $0 BALANCE MONTHS AGO - THEN GOT A $5 CHARGE FOR ONLINE PAYMENT. THEY DID TAKE THAT CHARGE OFF - BUT ONLY AFTER NUMEROUS EMAILS AND PHONE CALLS.
HOWEVER...AND HERE'S THE REAL KICKER: I JUST RECEIVED A LETTER FROM THEM, (VIA MY MAILBOX) THAT STATES: "HELLO, YOU WILL SOON HAVE A NEW CREDITOR. YOUR 'CLOSED' ASPIRE ACCOUNT WILL BE TRANSFERRED FROM COLUMBUS BAND AND TRUST (THAT'S IN COLUMBUS, GA) TO COMPUCREDIT CORP. ON AUG 22, 09. ETC.
THEN GOES ON TO SAY: "YOUR ACCOUNT WILL REMAIN CLOSED TO NEW TRANSACTIONS" ETC.
THERE ARE TWO NUMBERS ON THIS LETTER TO CALL - I CALLED BOTH. ONLY ON THE NUMBER: 7-800-839-9710, WAS I ABLE TO GET SOMEONE - (BTW: I HAD TO CALL 3 TIMES JUST TO GET THE ATLANTA FAX AND PO BOX MAILING ADDY FOR ATLANTA) - EVERY ONE OF THESE CONTACTS AT THE TOLL FREE NUMBER...ARE IN PANAMA...AS IN THE COUNTRY - NOT PANAMA CITY, USA.
MY ACCOUNT WAS PAID IN FULL, MONTHS AGO. IT SHOULD (AS THEY SO PUT IT) REMAIN CLOSED. IT SHOULD NOT, UNDER ANY CIRCUMSTANCE, BE 'SENT TO' ANOTHER CREDITOR. I NO LONGER HAVE AN ACCOUNT WITH THIS COMPANY.
MY LAST RESORT, WHICH BEGINS THIS WEEK, IS TO FAX ASPIRE (THE ATLANTA OFFICE) AND SEND TO THEIR P.O. BOX; A LETTER STATING THAT UNLESS THEY COMPLETELY REMOVE ALL MY INFORMATION - I WILL TAKE FURTHER AND LEGAL ACTION.
