    Apparently this is a third party collection agency and they are calling to collect on an alledged debt.

    If you know that you do NOT owe this debt, immediately dispute it VIA certified mail with return receipt requested. Keep copies of everything you send. Per the Fair Debt Collection Practices Act (FDCPA) they have five days to respond. If they continue calling or attempt to get a judgment against you without first providing proof that you legitimately owe it, you can sue them for statuatory damages:

    VIA CERTIFIED MAIL

    Dear {insert name of collector or company},

    I am writing in response to your (letter or phone call) dated {insert date}, (copy enclosed) because I do not believe I owe what you say I owe.

    This is the first I've heard from you, or any other company on this matter therefore, in accordance with the Fair Debt Collection Practices Act, Section 809(b): Validating Debts:

    (b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.

    I respectfully request that you provide me with the following information:

    (1) the amount of the debt;
    (2) the name of the creditor to whom the debt is owed;
    (3) Provide a verification or copy of any judgment (if applicable);
    (4) Proof that you are licensed to collect debts in (insert name of your state).

    Be advised that I am fully aware of my rights under the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. For instance, I know that:

    Because I have disputed this debt in writing within 30 days of receipt of your dunning notice, you must obtain verification of the debt or a copy of the judgment against me and mail these items to me at your expense;
    you cannot add interest or fees except those allowed by the original contract or state law.

    You do not have to respond to this dispute but if you do, any attempt to collect this debt without validating it, violates the FDCPA.

    Also be advised that I am keeping very accurate records of all correspondence from you and your company including recording all phone calls and I will not hesitate to report violations of the law to my State Attorney General, the Federal Trade Commission and the Better Business Bureau.

    I have disputed this debt; therefore, until validated you know your information concerning this debt is inaccurate. Thus, if you have already reported this debt to any credit-reporting agency (CRA) or Credit Bureau (CB) then, you must immediately inform them of my dispute with this debt. Reporting information that you know to be inaccurate or failing to report information correctly violates the Fair Credit Reporting Act § 1681s-2. Should you pursue a judgment without validating this debt, I will inform the judge and request the case be dismissed based on your failure to comply with the FDCPA.

    Finally, if you do not own this debt, I demand that you immediately send a copy of this dispute letter to the original creditor so they are also aware of my dispute with this debt.

    A Mr Cleveland from Dorsey, Thornton, and Associates called my place of employment on 1/28/2010 stating that he was a detective and that I had an outstanding debt and that he will have me picked up from my job. This was stated to the switch board operator in which she informed me of such. I called Mr Cleveland about the statement made and to ask that he or any other persons of that office to not call and harass my employer or anyone at my place of business. I also asked him for the name of his company and address and he refused to give me that information, the call was disconnected. I called back to retrieve this information and again he hung up in my face. I called back about 5 more times again trying to retrieve information about this company and Mr Cleveland stated that he did not have to give me any information and again hung up. I called back and a Mr Dardin answered the phone and I again asked for the same information as before, he immediately got an attitude with me and stated that "you got the right one now and we can play these phone games all day". I stated to him that all I wanted was some information about the company and information on the debt that I am supposed to have with them. Mr Dardin stated that, "I do not care what you want, and you better eat your chicken wings today because you will not be eating them for the Superbowl and that I will report your driver's license so that your tag will be taken away", he then disconnected the call as Mr Cleveland did. I called again asking for information on the company and Mr Dardin stated, "do not call this number again". I thanked him and hung up.

    For the life of me I don't understand people who get upset when someone calls them over a debt they owe. If you are a debtor and you borrow money from a company, pay it back. The company was there for you when you needed the money, so why not pay it back. If you can't pay the whole balance then set up an arrangement to make partial payments. Not one time have I seen where any debtor actually wanted to pay but wasn't allowed. Instead of trying to find ways to get out of paying your bills, which is just plain irresponsible, why not actually attempt to pay back a debt that you probably are legally and morally responsible for. So stop complaining and see if you can work out an acceptable repayment option.

    I agree that it is every person's obligation to pay back one's debt. The problem I have is the tactics collection agencies use when collecting these debts. Dorsey, Thorton, and Associates told me and my parents that a warrant would be issued for my arrest in a matter that was not criminal -it was civil. When I asked to make monthly payment arrangements, I was told that I would have to pay the amount owed by 3pm or risk being arrested. This was a lie told to scare me into giving them money I did not have. Initially, they would not give me the actual name of the company. They also refused to give me their mailing address. I did not have their mailing address until I looked them up on this website. The tactics of this collection agency and many others are there to cause anxiety and panic with consumers who do not know their rights or debt collection law in their state. At times, the tactics are illegal. Consumers should be aware and share this information.

    I totally agree Courtney, you are a exception to the rule. You actually are trying to do the right thing. I would suggest you contatct the management of this company and see if you get your concerns addressed. If they are any type of real company they will allow you to make arrangements and discipline any employee who states such things.

    Mr Cleveland also called me on a debt collection call and told me that he was going to issue a warrant for my arrest over a debt. He was also very rude to me. He stated that he was with a law firm, when I researched his company he actually works for a collection agency. He stated that he has been with the business for 15 years, when I researched the company I found that they have only been in business since 2009. They are a debt collection agency trying to scare people with jail and things. I totally agree if you owe the debt pay it but there should be some type of law to prohibit companies from lying about who they are and threatening people with things that can't happen.

    I did some investigating myself, All the agents from this collection agency can only recommend that warrants be filed and that is if only the statutes apply to the particular check. If the check is less than $500.00 its not worth to apply for a warrant anyway. Even if a bad check warrant is applied for, if the person goes to their county's bad check division, they can usually pay it. You are correct they are not a law firm at all. You should contact the management team at the company and complain. As always I still believe we should worry less about the tactics and more about owing the debt. I am a debtor myself and what I have figured out in my time negotiating with collection agencies and law firm's is they only get nasty when I tell them I can't pay. As long as I work out arrangements they are nice. Call the office speak with top level management you will get the opportunity to work it out if you really want to.

    To concerned citizen. I received a call from Mr. Cleveland stating that he would send a warrant out for my arrest.  He wouldn't give me the company name and lied and said he was calling from an attorney's office.  I agree I owe the debt I wanted to pay it back.  He hung up on me several times and finally when he agreed to talk to me he kept saying I was involved in criminal acts.  He refused to take the payment that I was offering becasue I wanted to mail it certified mail with a certified check.  How can i attempt to pay a debt back with people like this on the other end of the line.  Please understand my debt went bad because I had a husband who had a nervous breakdown and was unable to work.  Now that i can pay, these debt collectors and making it virtually impossible!!  I can't sleep at night, I worry and they hound me only at work and then with threats like these, I have no choice but to seek legal counsel against them.  It's not that I don't want to pay the debt, I have every intention to but they have pushed me up against a wall by refusing to take smaller payments and still calling me constantly and threating!!

    My son-inlaw was contacted by a women who identified herself as investigator Johnston. She said that he owes approixamatley $798.00 for a pay-day loan that he got three years ago for $250.00, right before he got laid off from his construction job.  My son-inlaw has three young children, and was working in construction before the real-estate crash. He now is working part-time and is just barely surviving. The investigator said if he didjn't pay $266.00 immediately, she was going to have him arrested for fraud. He offered to pay $30.00 per month, and would pay more when work picks up. She refused that offer, and is giving him until July 5, 2010 to come up with the first payment of $266.00. She also wants two more payments of $266.00 for the next two months for a total of $798.00 for a $250.00 loan! She says if he doesn't pay she will have him arrested immediately. Now what good is that going to do, then he will lose his job, and his wife and three young children will have to go on welfare and nobody gets paid.

    DO NOT PAY DORSEY THORNTON

    Demand written debt validation and report their behavior to local media in Atlanta. This agency is located in a house in Union City and is leaving illegal messages on voice mails.

    Send them a cease and desist letter and report the to the FTC

    This is a company that cannot collect on the debts anyhow, let alone threaten jail time.  If your payday loan was online, there is probably an eighty to ninety percent chance that the original loan came from an illegally operating and unlicensed lender that charged rates in excess of state laws.  In fact, most (not all, most) online payday lenders are not licensed to operate in any state.  Check it out carefully with state agencies.

    Refer to the Bud Hibbs consumer websites.

    Concerned Citizen is probably a shill for that agency.  I'd bet on it.

    Further, "deferred deposit" transactions, such as payday loans, are not subject to the check writing laws of many state.  Explicity.  A reputable payday lender tells you this upfront.

    Its funny how long I've been gone and yet I still get mentioned. Listen I don't work for any one of these collection agencies. I couldn't do that kind of work. Anyway, if a debt is owed pay it. The bottom line, no matter what chaz says, is you borrowed money so pay it back. There is nothing wrong with that. Chaz says the online payday loan is illegal, whether it is or isn't is not the question. The question is , did thay loan you money in good faith? Did you know about the fees if it defaulted? Did you understand the terms and conditions? Don't let anyone tell you to not pay a legal debt. If you want help because you are harrassed, threatned, or just want to know your rights, that is one thing. But a person that advises someone not to pay is not ethical, honest, or trustworthy and should not be listened to. Find out what you owe, the balance, not all the extra fee crap, find out the address, send them a money order with a restricted endorsement "paid in full" if they cash it you are done. Just a FYI for Chaz, I actually found thier office and main number and I don't even know what I'm doing. Stop giving people bad advice and get a life.

    You still get mentioned because you are giving out "interesting" advice that isn't rooted in law.  Clearly, you like to watch this page, too.

    If you're interested in this subject, you're either connected to a collection agency or a debtor affected by this phone number or company.  If those two areas are not why you've taken an interest, then what is it?  Me:  I'm here because we get funny calls at the house threatening jailing and these people need to be stopped.  They are just like the scam in Buffalo that recently was shut.  Dorsey Thornton won't prove ownership of debt paper.  Dorsey Thornton is unlicensed to even operate in its own state.

    Further:  Restricted endorsements are not necessarily legal in all states.  Check your facts.  You may be entitled to your own opinion, but certainly not your own set of facts.

    The original point is this. . . if the lender is unlicensed and violating interest rate laws, they are not a "legal" debt.  If the collection agency buys the illegal paper, they are equally liable.  A reputable collection agency will not buy these accounts.  I personally know of three agencies that got out of trying to collect unlicensed payday loans for this very reason.

    Numerous states have slapped desist and refrains or shutdown orders on the lenders.  They all go ignored.  The vast majority of the lenders online that are unlicensed relate to an umbrella company called "ameriloan", and are supposed to be based on a reservation in Nebraska.  They aren't.

    You sound so angry.  Typical internet   You're absolutely correct about one thing.  Your last statement.  You don't know what you're doing.  You are clearly a shill for collections.

    Wow.  I guess God's on Dorsey Thornton's side.  I never knew.

    The bible also tells women they've got to be miles away from others when they're on their period.  I'm not going to play quotation games.  You may also recall Jesus wasn't terribly pleased with usury-prone moneychangers.

    You have elected to answer none of my statements.  Why should I let you direct this discussion?  Still, I will grant you this much because unlike you, I will answer questions.  It is morally right to return the money borrowed.  Not $900 or $1500 for a $300 loan, and not what Dorsey Thornton decides on a whim.  Frequently, these online payday lenders took more than they were contractually entitled to out of people's bank accounts, but then still sent them to collections.  What shall we do in this circumstance, being that you know so much about it?

    I need you to answer these questions.  If you can't answer, I will not give you any more of my time.  If a person cannot pay a dime, what should happen to them?  Are you of the belief that arrest and jailing is ok?  Is profanity ok?  And further, is it ok that Dorsey Thornton calls at any hour they like?  Is it ok that they insult people?  Is it ok that they have no license?

    The point is that Dorsey Thornton, unlike other debt collectors, threatens jailing for debts and cannot even substantiate the claim.  They threaten jailing and, by deeming themselves to be INVESTIGATORS with the authority to PROSECUTE, are bearing false witness against thy neighbor.  Thanks.  You're awfully angry for being so Christian.  I'm sure your experience in bill collections has trained you well.

    If you have even bothered to look at any of my posts, I have never agreed with tactics of these agencies. Point blank its not right!! I also beleive you have to be an adult to get these loans. The consumer has the option to read and decline the contract based on the ridiculous fess associated with it. I believe we are more on the same page than you want to admit. I don;t agree with telling people they are going to jail, there are no debtor prisons anymore. I don't believe in treating people with disrespect just because they owe money. I do believe rouge agencies should be reported. All I have ever said is, if you can read, you get into these loans with your eyes wide open. Its a fact that most payday loan receipiants abuse the process, they receive many loans and very rarely pay them all back. That is a fact. There is a two way responsibilty in this whole process, the consumer and the creditor. CAn you at least admit that?
