They weren't that professional on the phone, and claimed they send letters but no response . So I asked them to verified and send me thru email. This is the address on the documents

- KatherineThey called me, with a name that was off a little. They reported a civil law suite was going to be filed against me. Because it was not really my correct name they would take me off their calling list. They were vague.

- MonicaI had a voicemail from this #. Edmonds and Associates. She first said her name was Roxy McCrary, then when I questioned her, she was unprofessional and rude, she put me on hold. I hung up and called back and it was the same girl, as she referenced me by name and when I asked her name, she said Jordan. What is disturbing is she had previous addresses I had lived at, but have not lived in over 10-years. When I called back, she was able to pull my current address and said she was coming for me, I called her a scammer which made her more upset. How do we report these people so they stop harassing people?

- AmandaI just received a call and got the same about a lawsuit, they had my address and last 4 social but when asked to email me papers about the matter, nothing. Big SCAM fortunately I work for a firm and they would not call you but send a certified letter and call but not with 877 number! Be careful people it’s the holidays and these goones are out to get innocent people! Freeze your social security number as well which I have done and contacted Social Security with this number listed!

Don’t you think if you actually had a civil matter against you, you would already received something in the mail about this and not a call and some vague information.

Actually called that law firm to let them know the address these scammers are using belongs to Williams Law Group APC. Just contacted Willams Law group to let them know that these scammers are using their address. They are investigating.

Websites that list all your family, neighbors, and even people you have never heard of? Pictures of your house (Thanks Google)? The DMV selling your information? Data miners galore gathering every possible fact about you? Facebook, Google, et. all gathering every possible fact about you and all of them selling it to anyone who has the money?
- BigACriminals are masquerading as debt collectors in an attempt to extort money from people by scaring them into believing that:
a. You are going to be sued and it will cost you lots of money when they allegedly “win” their case.
b. That they are about to file criminal charges or that you will be criminally charged (they use the bad check or hot check claim a lot) and go to jail, even though debt is civil not criminal, there are no criminal charges, and debtor’s prison was outlawed over 200 years ago.
c. That they will take away your driver’s license.
d. That will garnish your wages without actually suing you, going to court, or even winning a case and obtaining a judgement followed by a judge’s consent to the garnishment. They also claim that your wages will be garnished in amounts far above all legal limits which are described by the Dept. of Labor here: https://www.dol.gov/whd/regs/compliance/whdfs30.pdf
One of the tricks they use is to call your family, friends, neighbors and/or places of employment (past or present or both) to create panic and embarrassment so that their intended victim calls them so that they can scare that person into paying extortion money. They will usually also state information that would be illegal for a real debt collector to state to a third party such as that you are being sued, that you owe money to someone, etc. They threaten that if you do not call them back, they will contact your HR department and tell them that you are a deadbeat who does not pay their bills. They often call people that have never even been associated with you because they get erroneous information off the internet.
They will use the words “Mediator”, “Arbitrator”, “Law Office” or claim that they are a “Lawyer or Paralegal” to make you believe that they are something other than a debt collector want-a-be and that they don’t have to follow Federal and State collection laws, even though they do have to follow those laws. They also tell you that if you fail to call them back you are "waiving your right to council" or that “the case will proceed without you” which is pretty much nothing but hogwash. They tell you that they need a “statement” from you regarding the complaint and if you don’t call back they “wish you good luck as things unfold”. They use the phrase “consider yourself notified/served” or “govern yourself accordingly” a lot, something they should do themselves. They claim they are officers of the court, or that an officer will accompany them, or even that they are sending officers to arrest you. All hogwash. They are now also claiming that they will be in an “orange vest” and they tell you to lock up your dogs and guns for “everyone’s” protection. More hogwash.
The fake process server extortion attempt usually consists of the following:
They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency. They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer). They threaten to serve you at home or at work. They tell you that if they serve you at work then they will need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work. They also tell you that you will need two forms of ID. None of which is true. Process servers do not ever call ahead so that you can dodge them. Process servers get paid to serve papers, nothing else. They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”. Court documents are time sensitive and must be served within a certain amount of time. Remember that you can always call the local courthouse to see if there really is a lawsuit that has been filed against you.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

She really made it sound legitimate from a company back in 2011. I didn't recognize the creditor name (Mid Trust or something like that), but it may have been an old credit card. I am not sure. She said she is mailing & emailing me the paperwork (she said I was first mailed the paperwork in Sept). I told her I was disputing it. She said I have until 11/26/19 to respond, and if I don't, then the next day my court date will be set to go forward with garnishment or bank levy.
I know a lot of these are scams and whatnot, but for some reason, this one really sounds real. - BigA replies to Barb| 2 repliesUmm, no. If they are mailing you the dunning letter (or even emailing it), then you have 30 days from the receipt of that letter to dispute the debt. However, that must, by law be done in writing and should be sent certified, return receipt so that you can prove that they received it. No one gets to set a court date. The court does that and it certainly will not be the next day, especially when there is a holiday coming up. They cannot go forth with garnishment or bank levy until they sue you and win. So, they need to file a civil complaint with the court, properly serve you, and then give you 20 to 30 days to answer that complaint. Of course they won't do that because they would have to give the court their real company name and address and then you could counter sue them for FDCPA violations.
