    got a call from a miss walker who is somebody for Atty Goldstein.....possible garnishment of wages, got a case file, wants to get a statement on file, yada, yada, yada.  It was a call for someone I have no idea who it is.  But anyway  That is impossible to get a garnishment of wages in the state of texas with 2 possible exceptions.  This is probably a bill collector of some sort,

    Similar call as previous comment above got a call from someone claiming to be from Attorney Goldsteins office says they are going to file a claim against me in my “jurisdiction” . Funny I’ve gotten no written correspondence from this office and their phone number doesn’t come up with any legit organization much less a law firm.

    Received call from Joy Morgan stating that I had 3 loans with/in 30 day period in 2014.  Impossible!  Anyhow, told her that I would have my attorney call.

    I just returned call and requested attorney's contact information, such as address and phone number directly to the attorney's office.  Now she states that she can't speak to me legally and that she is not able to provide contact information.  My attorney has to call her to get it.............

    It is interesting how they fall back on the law when they have no way to scam you anymore.  Once you have told them that you are represented, they legally can't contact you anymore.  In this case I doubt they will be calling your attorney either.  I sincerely doubt that this is really an attorney's office calling you.

    Whenever someone tells you that they are a "lawyer" or that they work for a lawyer or law firm, the first question you should ask is what state(s) they are registered in and their BAR number for that/those state(s).  Then go to that state and check them out, contact them directly using the information in the state registration, as these crooks have been known to research real law firm names and attorney names and impersonate them.

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
