- Stephanie| 9 repliesI just got a call this morning that disguised itself as a local number, but the call back number they gave me was 1-877-350-7936. I spoke with a woman named Alicia Cherri who said she was from Goldstein and Associates in California. LA to be exact. Gave me an address of 8939 south Sepulveda Blvd...which upon research turned out to be a "virtual office" for sale. Said she was representing some bank that I've never heard of saying they were taking me to court over $200 I supposedly owed from almost 10 years ago. Somehow had my phone number, but didn't have a current address for me. Asked for a debt verification letter and the woman got really nasty with me. She said she didn't have to send verification to me because they've supposedly sent 3 already over the last 3 years. **RED FLAG**. I keep pretty good track of my credit report, and had the supposed account went to collections, it would have showed on my credit report (which it never has). I asked the woman an address to where they were located and she got even nastier with me and decided to put me on hold. I was then connected with a "supervisor" Robert Griffen. He's the one that gave me the virtual address. Said they couldn't send me a debt verification letter because they stopped sending mail several months ago because people were not getting their mail...hmmm..I wonder why! Nothing but a huge scam!!!!
- BigA replies to StephanieYes it is, they are required to send out a dunning letter. However, at 10 years, that debt would be past the Statute of Limitations in most states and suing or threatening to sue would be illegal.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

- CWG40If you call that number, they ID themselves as "Goldstein and Davis". Deny that they are debt collectors. Guy said they were a "law firm". Right. Just another debt collection scam. No idea where the principals of this group are located.

Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.
If a voice on the telephone claims you owe a debt:
1. Demand the person give you his or her name, company name, and address
2. Demand a debt validation letter by US mail. E-mail no good.
3. Do not pay the collection agent or anyone else a dime until the debt is validated
Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.
If they are bothering you, report them:

Note that the US Supreme Court in the Case of HENSON ET AL. v. SANTANDER CONSUMER USA INC., has recently ruled that the provisions of the Federal Fair Debt Collection Practices Act do not apply if the creditor owns the debt in question. As a practical matter this probably won't effect the kinds of scam debt collectors who often show up on 800notes. The scam collectors don't give you any information about themselves so it is impossible to know whether or not they in fact "own" the debt in question. Most do not send debt validation letters and many often say they are collecting for someone else. So, make the complaint anyway if they are bothering you. Let the FTC sort it out.
Also contact your local attorney general
If they continue to bother you, and you know you do not owe any money, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.
You'll probably have to yell at them and talk over them. Tell 'em no scammy debt collector is going to push you around.

- AmyThey called my parents where I haven't lived in 20 years and used my maiden name told my parents that they were going to my last place of employment and started threatening my 70 year old parents. I attempted to contact them back at the 877-350-7936 number but on my parent's caller id it came up as (937) 660-5747. The number went straight to voicemail with no message other than Goldstein & Associates.

- Christine| 1 replyThe woman who called me and gave me this number used the name Melissa Huff. She told me I had an unsettled overdraft from Wachovia Bank from 2011. She told me many letters had been sent to an address I had lived at for less than a year in 2008 and that I never gave that bank. She called me at my cell number that I have only had for 2 years and said that it was the number I gave the bank, then called me at my parents number. Both times, the number showed up as being local. When I told her I would make a decision and call her back, she started getting irritated and I had to ask for it several times while she argued. She finally gave me this number. For the record, the amount of money it would cost to pursue this debt is way, way more than the debt itself. I didn't even have an account at that bank in 2011.

- AnonymousI got a call from this number a lady left a voice mail sayin they were from davis n watever law firm i return the call n a guy answered claiming i had a bank account with wells fargo and owed $400 he was rude. Tried to get my card information... and would mail me documents of this bill. He refused and said i would be sent to court if i didnt pay. I called wells fargo and i owed nothing i havent banked with them in 5 years... plz be careful these ppl are insane. And will try to take ur money.
