This BCM place is a scam, I had a online payday loan that I got behind on, this place "sent someone" to an extremely old address of mine and I wasn't there. Left a phone number and a "case number" called the numbe and they threatened processing fraud charges. Debt collection is a civil matter, to press fraud means they would need to hire a lawyer, I called back asking for he lawyers bar number which they wouldn't give, asked for their physical address which they wouldn't give. This place is trying to scare you into paying a debt, nothing more. They offered to "stop with the charges" if I arranged a payment.

- TracyThey are trying to collect a debt on a payday loan for Sonic Cash, which is a company operated out of Costa Rica. They called my boss and insinuated that I was about to be charged with a crime but they preferred to take care of this matter away from my work. My boss freaked out and called me - I was at home sick. When I spoke to them, they then tried to claim that I was being charged with fraud and check fraud. I asked them if they were trying to say I was being charged with a crime, to which they exclaimed "No!". Debt Collectors are not allowed to claim that you will be charged with a crime and/or that they are taking criminal action against you. They wanted to come out and "serve" me right away, and I said "come on out". They never showed up, especially after I told them that I was an attorney (this is not legal advice; I am writing this as a consumer; I no longer practice law). Anyway, they couldn't scare me into paying with this ruse. They would have to file a lawsuit against me to "serve" me. They would probably never file a lawsuit against anyone who owes a company less than between $5000 to $10000; Further, and most importantly, they would probably never sue anyone who has no non-exempt assets to seize with a judgement. A person is entitled to a certain amount of real and personal property; it depends on your state. It costs time and money to sue someone - from court costs to the costs of filing pleadings and trying to find assets to secure. It would cost them several hundred dollars just to file suit. The collection company probably bought your debt from Sonic Cash for less than you owe in principal. Therefore, unless they are really stupid, why would any company spend more to sue someone than they could possibly obtain?
Even if you owe them $1000, they would spend far more than that in pre-lawsuit activity. No District Attorney has every filed check fraud charges against someone based on a payday law. Remember, even if they show up at your door and "serve" you, it is probably just a letter, regardless of what scary language they may use in it. Just take it. A letter means absolutely nothing. Read it carefully, and if it is letter, save it because you might be able to use it as evidence in a case against them for violating federal and state fair debt collection acts. Also remember that all of this information is available for free off the internet. Just Google or Bing payday loan collection law, check fraud for payday loans, fair debt collection law in your state and federal law, etc. It's not like the old days when the law was kept locked up in law libraries. If you are still afraid, then go and talk to an attorney who practices bankruptcy and/or consumer law. Bankruptcy attorneys know the law on exempt property and can advise you as to your best course of action. They will probably talk to you for free. Finally, please contact your state attorney general's office, who can direct you where to file a complaint, such as the office of the consumer commissioner and/or its federal equivalent. Also, please contact your state, local and/or federal congressman/woman and senator's offices for assistance. They have a staff of people working for them to help their constituents with such problems. Document every call or contact and if you can, tape record the calls.
