- crystal| 2 repliesReceived a call from this number, they left a message by the name of Jeannie, stating its in reference to their location and tracing efforts and if i didnt call back they would contact references and that the law allows them to contact them. Decided to call them back, spoke to a guy that wouldnt repeat his name, and he researched my phone number and started accusing me of lying about who i was, they never asked lol however when i questioned them on why they were calling they refused to give me any information. I advised them its illegal for them to call people based on a scam and told them that when my phone rang, a scam alert came up and I offered to have them speak to my lawyer and they hung up.

PATTERN OF COMPLAINT
BBB found a pattern of complaint exists concerning lack of customer service and difficulty for consumers to obtain dunning letters with validation of debt information. We have also identified a pattern in your responses to complaints stating that your company has done no wrong doing and providing a validation of debt letter. Not all components of the complaints are being answered or addressed. This includes threatening the consumer which a number of the complaints reference your company doing and releasing personal information about the debt to third parties.
ALERT
Collection agencies are required to be licensed or bonded in many states in order to operate and contact consumers about outstanding debts. BBB has reached out to this business requesting that they provide proof of licensing and bonding required for operating everywhere they do business. However, they have failed to respond to our requests.
BBB wants to make consumers aware that they have legal rights when they are contacted by a collection agency. The Fair Debt Collection Practices Act (FDCPA) prohibits abusive and harassing behavior by any debt or collection agency, this act is enforced by the Federal Trade Commission, FTC. The act states specific practices and rules under which debt collectors must abide by. There are penalties for agencies found breaking these laws. Collection agencies must not use crude or offensive language or identify themselves as anyone other the business name that they are contacting on behalf of. If a consumer believes a debt or collection agency has violated any of the FDCPA laws the BBB encourages them to file complaints with the BBB at www.bbb.org and Federal Trade Commission at www.ftc.gov.

In any event,
Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.
If a voice on the telephone claims you owe a debt:
1. Demand the person give you his or her name, company name, and address
2. Demand a debt validation letter by US mail. E-mail no good.
3. Do not pay the collection agent or anyone else a dime until the debt is validated
Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.
If they are bothering you, report them:
http://www.consumer.ftc.gov/articles/0149-debt-collection (Threatening civil proceedings with no intent to follow through, or threatening criminal process in order to collect a civil debt is a violation of the Federal Fair Debt Collection Practices Act.) The same goes for endless telephone harassment.
Note that the US Supreme Court in the Case of HENSON ET AL. v. SANTANDER CONSUMER USA INC., has recently ruled that the provisions of the Federal Fair Debt Collection Practices Act do not apply if the creditor owns the debt in question. As a practical matter this probably won't effect the kinds of scam debt collectors who often show up on 800notes. The scam collectors don't give you any information about themselves so it is impossible to know whether or not they in fact "own" the debt in question. Most do not send debt validation letters and many often say they are collecting for someone else. So, make the complaint anyway if they are bothering you. Let the FTC sort it out.
Also contact your local attorney general
If they continue to bother you, and you know you do not owe any money, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.
You'll probably have to yell at them and talk over them. Tell 'em no scammy debt collector is going to push you around.

She said that she would call references and the law and it was important that I return the call even if I didn't know the person. It wasn't my name and I didn't know the person. I didn't return the call but researched the number. It seems it's a fake loan scheme.

I NEVER answer calls from numbers I don't recognize. If caller leaves a message, I listen to it and check number from which call was made to see if it matches caller ID. Then I check 800notes and google the number to obtain as much information as possible.
I planned to block this number, but decided not to block it to see how many calls/messages I receive for the purpose of filing complaints with the AG of CA and the FTC,
Lo and behold, I received a call and same message from a different number today @ 1:30 pm PDT, which is not listed in the above comments.
So, please add to the list of numbers used by these criminal scumbags 877-418-7841.- Caller: BRG?
