    The person had called and stated that I had a case against me in court from a 2008 credit card which I do not even recall opening. Then he proceeded to tell me that if I did not want to go to court I could settle this with him for payment arrangements of $348.00 ; the original charge plus restitution was $1148.00. I am not sure if this is legit and I informed him that I would not provide him my banking information unless he sent me proof of owing this debt; he had my previous address which I have not been at for 7 years and my SS. The credit card company was named Continental and also provided me with an account number. How do I find out if this is legit and also the gentleman was extremely rude with me. He also informed me that I should have records of accounts that were not paid off in 2008.

    It is incumbent upon them to prove that the debt exists and that you owe it.  Not the other way around.
    This is a common ploy by criminals attempting to extort money from people by scaring you into believing that you will be criminally charged, go to jail, lose your driver’s license, have wages garnished, etc. all for an alleged or nonexistent debt.
    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

    They called my job with some bogus claim about a credit card sonsored by Continenal Bank, whom I never heard of. I told him I filed bankrupcty and they shoudln't be calling me no way. He hung up??

    I just got the same call from the same company and same story i never had a credit card from this company and they had my full ss number and my address. i would not give them any of my personal info i just told them i will see them in court. this is a scam please do not fall for it.
