- Frank| 2 repliesI called to an Avery Moore who claimed to be a process server for Charlotte County Court. She said that she tried to serve me with court appearance papers and was unable to serve them. She gave me a phone number for a Michael Harris and then was transferred to another person named Brian. He sounded really shady. He said I owed Master Card 8K from 2001 and they are trying to collect. Charlotte nor Pinellas County have any records regarding any court issues with me.

- A Wise| 1 replyFirst, got a call from an unknown caller. Said they tried and failed to serve me. Said Citibank CC from 2008, I owe $21K. Told me to call this number. I called. They threatened to put a lein on my house. They knew I have a car payment and other credit cards -- said those accounts have put in a request to know the outcome of this case. Gave me a settlement amount of $6400. I redirected them to address to serve me, they said within 72 hours. Never served. I called back, gave case #, they hung up. Called back again, busy. Called from a different number, gave case #, they hung up. Called back again, busy. Tried *67, busy. It seems obvious it's a scam but what if it isn't? How can I find out if I have a court date?

- Tygerkat replies to A WiseYes, it's a scam. First of all, real process servers don't call in advance. Second of all, a legitimate debt collector wouldn't hang up on you.
Oh, and just FYI, *67 strange work when you call toll-free. - NathanThis number has contacted me numerous times leaving the same voicemail stating I have legal documents that were not delivered or signed for. I did answer the phone once and the caller was referencing a debt almost 30 years old. Could not get company name or name of caller to report.

- Elaine| 8 repliesThey keep calling me saying that same message other people are receiving regarding failed attempts to serve legal documents and requesting a returned call to Attorney Tracy Williams (877.643.0716). I returned the call letting them know I have reported the calls to the San Antonio Police Department and not to call my number again.
- Caller: Process Server from Bexar County

- BigA replies to Elaine| 7 repliesThis isn't a police matter unless you paid them money.
The fake process server/location finder extortion SCAM usually consists of the following:
They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency. They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer). They threaten to serve you at home or at work. They tell you that if they serve you at work then they will need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work. They also tell you that you will need two forms of ID. None of which is true. Process servers do not ever call ahead so that you can dodge them. Process servers get paid to serve papers, nothing else. They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”. Court documents are time sensitive and must be served within a certain amount of time. Remember that you can always call the local courthouse to see if there really is a lawsuit that has been filed against you.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter, email, or text (postmarked in the case of a letter) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. Unless they have communicated it to you verbally at the beginning of your conversation. It also must contain the “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this communication must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that communication you should immediately send that debt validation letter by certified, return receipt mail.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/
Also file a complaint with your State Attorney General's office.

- JJ101471 replies to BigA| 6 repliesThank you for all the information. Regarding these "Debt Collectors" all communication should be written and not over the phone. They should verify the debt before you take any action. Do remember that whatever the debt, these collectors pay a fraction to get the account to then have the person repay the full amount. There are statute of limitations on some of the debt. Once it's off your credit history, you may not have to repay the debt. But do your research and don't fall for these scammers.
- BigA replies to JJ101471| 5 repliesBefore you try to give advice I would suggest that you take the time to learn about the subject first because your post is rife with errors.
- JJ101471 replies to BigA| 4 repliesMay I ask what the errors are?

I'm not sure what you meant by this. It may be correct but it is completely unclear.Quote:They should verify the debt before you take any action.
Doesn't matter since you agreed to this somewhere in the contract.Quote:Do remember that whatever the debt, these collectors pay a fraction to get the account to then have the person repay the full amount.
Yes, but that only covers lawsuits in 48 states.Quote:There are statute of limitations on some of the debt.
Once it is off your credit report it might not be a good idea to not repay the debt but it does not mean that you don't still owe the debt and has nothing to do with preventing you from from repaying it. As toQuote:Once it's off your credit history, you may not have to repay the debt.
Obviously I have done my research, have not fallen for scammers or even actual debt collectors and have successfully sued some of them.Quote:But do your research and don't fall for these scammers. - JJ101471 replies to BigA| 2 repliesI see. I understand. You do make sense. I must wonder, which scam companies have you sued? Have you sued any of the big ones?
- BigA replies to JJ101471| 1 replyNice try but if I told you which ones that I sued then you would know who I am and where I live.
