- BigA replies to Tawni| 4 repliesWell they can't garnish wages until after they sue you. They have to properly serve you first. This is a debt collection extortion scam.
Whenever someone tells you that they are a "lawyer" or that they work for a lawyer or law firm, the first question you should ask is what state(s) they are registered in and their BAR number for that/those state(s). Then go to that state and check them out, contact them directly using the information in the state registration, as these crooks have been known to research real law firm names and attorney names and impersonate them.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

- BigA replies to Tawni| 2 repliesYou are very welcome! Remember that you already have an attorney who should be handling this. You paid him for that, and if you can figure out who this is you can sue them and make them pay you and your attorney's fees.

- BigA replies to TawniI would say yes on accepting the document. Depending on local laws they may simply be able to tape it to your front door. I don't know if your courts are closed or not. As I previously mentioned you should be calling them to see if you really are being sued. You should also be contacting your bankruptcy attorney as I previously pointed out as well. You already paid him to handle this stuff.
- Lu replies to TawniThese people said I'm being sued also and that I would be served in 2 days. This account is 6 yrs old and I already paid them off. He tells me that I can not make a settlement on the account and I have to pay in full or only 2 payments since it is under $1000. He was quite unprofessional and I never received anything in writing about this account at all. How can they sue me out of the blue.
