Kier Wilson (sp?) with the "Process Systems Division" left a message stating that there are two formal complaints against me in the county I live pertaining to a "fraudulent offense" (with heavy emphasis from him on the word word "fraudulent," while reading from a script), warning against potential litigation on the matter, and wanting to get in touch with my HR department to find out the appropriate procedure for serving papers to me.

1. If they haven't been filed, they aren't complaints.
2. I haven't had an HR department since I moved here a year ago, because I am a student.
3. Legally, in California (and per federal law in the US as well, under the FDCPA) they cannot state that they have intent to file litigation against me without actually intending to file--using it as a leverage term to get someone to call them back doesn't work.
4. He wouldn't state which company this was, and did not state that "this call is in an attempt to collect a debt," or anything of that nature--therefore, he's likely a scammer.

Good luck, Kier, and I hope you read up on the FDCPA and get out of there before your employer gets you in trouble.

I also got a call from an "unknown number" and a person by the name of Dennis Boyd called, said he was calling from "Legal Process/Summons Division" left a docet number which he said had been filed int the county I live in, and said it was a time sensative matter, left this 877-790-1390 to call back.  He said that I was going to be served papers, I may be wrong and I know things change with time, but anyone that is going to serve you with papers IS NOT going to advise you, they will just show up.  Again, I have asked for documentation on this "debt" , I will NEVER give out any personal information over the phone.  I will gladly resolve any situation only if you provide me with the proper paper work, so that I may verify this debt.

If this is a legit company, why would you use "scare tactics" to get this matter resolved, not everyone is able to just pay right away, we are all suffering and trying to make ends meet.
