    Extortion Scam Related to Delinquent Payday Loans

    Washington, D.C.
    December 07, 2010  FBI National Press Office
    (202) 324-3691

    — filed under: Press Release

    The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

    According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

    The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.

    The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

    •is seeking payment on a debt for a loan you do not recognize;
    •refuses to give you a mailing address or phone number;
    •asks you for personal financial or sensitive information; or
    •exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

    If you think that a caller may be a fake debt collector:

    •Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
    If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.•Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
    •Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
    •Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
    •Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

    I just had the same thing happen.  She stated I owed on a PayDay loan from June 2013.  I advised her this was paid in full and asked for her proof.  She refused and said I could dispute it with a judge.  Guess I will have to

    I just received a call from this number on my work phone! and it was a recording saying they are from WMG and Associates that there are charges filed against my name and social. titl1 8 section 1344 or something and to press a number to make a statement. This is the 3rd call i have received in regards to something like this. My name and numbers must be on  a list somewhere that these people are harrasing me. Makes me never want to apply for anything again because companies out there are selling our information and giving it to scammers like these.

    These folks keep calling, using a recording, that asks for me by name but this after it talks about legal proceedings, etc. The first time they called, I waited to speak to a rep, who put me on hold, then hung up on me.  Then I called the number and was told, they called in error.  Today I spoke with a man regarding an incident he claims took place in 2013 and further threatening me with legal proceedings.  When I requested he forward documentation to my home address, so I, along with my attorney could review what he was talking about and to stop calling my office number immediately. He said they would just send the documentation to my job and not stop calling.  I again, requested he stop calling, and if he continued to call my place of employment, I would report his company to the Maryland State Attorney General's office.
