- Anonymous| 1 replyCalled my brother and said they needed to reach me about a legal suite. I call the number with the case number they gave him, the guy that answered was "Nathan Foster with the legal department", I asked what legal department and he said "Prime Capital", he pulled up my full ssn, my maiden name, my married name, my old address, my current address, etc. Told me I was being sued for a bank account delinquent from 2008 (11 years ago!), closed in 2011. They told me my current county (which was correct) was trying to serve me papers and wanted to know when I would be home, he even asked are you home right now? Im not telling this guy nothing until I look up what this is and called my attorney. He told me if I didnt go to this court hearing I would automatically owe $4,500 in fees, late payment interest, legal fees, etc and I needed to let them know when I was home to be served (told me he couldnt give me the "court date" over the phone).
So I look up this "Prime Capital legal department", lots of different numbers but all the same story... SCAM!! Dont fall for this. Still freaky they had so much personal info and wanting to know when I would be home- Caller: Prime Capital Legal Department

David with San Diego County Processing saying that he was a courier at my house trying to serve me documents(said my address) he said that I would need to reach someone at another number 888-212-0687. I Called that number right away A guy name David answered the phone and said he was with Prime Capital and had all my info. He also told me that Told me I was being sued for a bank account delinquent from 2009. He said that my old account was charged off and that Wells Fargo is has filed a Civil suit against me and that I owe $1385.68 and if I didn't pay I would have to go to court and pay put $3885. I asked for the wells Fargo number to call, he gave me 877-647-8552. I looked it up but didn't see Wells Fargo name attached so I googled a branch in my area and they transferred me. Needless to say WF said that It would be best that i come into a branch- Caller: Prime Capital

She told me that I was listed as contact for my mother and that they have been trying for weeks to reach her, She (the caller) then told me that they were trying to serve court processing papers saying that she is sending a courier to serve my mother documents. She wanted to do me a favor and could hold them off for one hour if my mother would call them back within that one hour. We this is not going to happen as I will never give my mother the message which would upset her. This is very much a scam!!

- BigA replies to Good SonThe fake process server extortion attempt usually consists of the following:
They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency. They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer). They threaten to serve you at home or at work. They tell you that if they serve you at work then they will need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work. They also tell you that you will need two forms of ID. None of which is true. Process servers do not ever call ahead so that you can dodge them. Process servers get paid to serve papers, nothing else. They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”. Court documents are time sensitive and must be served within a certain amount of time. Remember that you can always call the local courthouse to see if there really is a lawsuit that has been filed against you.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.
