- Shana| 1 replyI checked my vm only to hear a woman by the name of Valery Flores stating she was calling from a law firm concerning a serious matter and i had 24 hours to contact them before they take matters into their own hands. She told me to call 8882121665 and gave a reference # in regards to the messgae so they could pull up the info right away. Is this a scam? Im confused because i do not have any issues for some one to call me like this.

- BigA replies to Wanda ComptonIt is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

- Anonymous replies to ShanaShana, I am a process server. We would never call anyone we are trying to serve and make such threats. No person filing a lawsuit needs the Respondent's "consent"...they just file it and get the person served. Do not call the number. I got the same voicemail on 10/4 from a Sophia Carson but was for my husband and said they received a complaint forwarded to their office about a possible pending legal action filed against him. The CallerID was "unknown". The firm number they gave to call was the same one you have. It's a popular scam.
