- R| 3 repliesThese people are relentless. They call my job, my house, my father in law, my dad, and they just keep calling. Threatening to send someone to my job and bring me a notice. They even lied and said I was writing bad checks in order to get me mad enough to call them. I said if i owed you for something then I will pay it. They hate for you to ask them questions and they always rude or get mad There number is 888-231-5355. Be careful everyone because they are rude. They will even change their number to a number in your area code. I don't know how they do it but they do. Their tactics are crazy!!
- Help replies to R| 2 repliesThey are doing the same to me. I offered to pay but the amount was ridiculous. Did they file to send you to court or did you pay or is this a complete scam
- Slim replies to HelpA phone call from a supposed debt collector is not legally sufficient evidence of debt.
The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:
* Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money. ["Written" means snailmailed ... not emailed or texted]

Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via green dot, Western Union, or other untraceable means, then the call is definitely not legitimate.
IF you wish to communicate with the supposed collector / creditor, visit the following page, for example "Action Letters" to snailmail:

If you KNOW you owe no money, or believe the call was from a fake debt collector, please take the time to read this:

Offering to pay is a foolish response to a stranger on the phone making bogus threats. In some jurisdictions that's enough to reset a Statute of Limitations and fling open the doors to a creditor lawsuit. But this extortionist caliber of collector either won't or can't file suit, which is what makes the process service threats illegal.
