Said that we were going to court and the matter could go to civil or family court but record had been sealed for his protection. Needed a call back immediately. Husband called and they wanted personal info from him.

- BigA replies to KellyThis is a common ploy by criminals attempting to extort money from people by scaring you into believing that you will be criminally charged, go to jail, lose your driver’s license, have wages garnished, be sued, and a variety of other variations on this, all for an alleged or nonexistent debt. One of the tricks they use is to call your work place repeatedly in an attempt to shame you into paying. They also use the “process server” who calls and claims he is going to serve you, but then says you could avoid it by calling another number.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

They were told numerous times that the account was discharged in my bankruptcy and that they needed to speak with my attorney and I gave them all of his information. They tried to use the "This type of account can't be wrapped up in a bankruptcy." On one of their calls, I had a lady screaming and yelling at me demanding I pay or the cops were going to show up at my house and arrest me in 48 hours. I asked her what address she had for me. Here, it was an address from 10 years ago. I said yeah, ok lady, too bad you don't even have my current address. I just called them back to get all of their info and now all of the sudden my case has been removed from the guys database. Really..... In 3 hours it disappeared??? Is that because you know you're involved in something illegal???

- Sick of these callsI gave in and actually called the number that the third party person told me to call, 888-240-2645, and spoke with Linda with Richmond Simon Law. They are located in southern California. She told me charges were being filed against me from Chase Bank for a Mastercard credit card for a past due debt. I asked her several times who it was for (HAD to be store credit card) and she responded with they don't do that. I know for a FACT whatever debt she claimed I owe isn't mine. I only had 2 store credit cards in 2004 and they were never associated with the address she gave me (an address that is the most "recent" on my credit report but is actually a place I lived at for about 6 months about 20 years ago WAY before I opened any store credit card.) Only 1 credit card that was that old was included in my bankruptcy a few years ago and this one isn't it! She wouldn't listen when I said it wasn't mine and said I'd have to prove that when I receive the summons to go to court. Yeah, right. I'll believe it when I see it. Besides, don't they know anything about statue of limitations??? So, I did the only thing I could think of --- I called them back and gave them my lawyer's phone number. She responded with they would deal with him from now on. I don't expect to hear from them again.
