called said they were filing civil suit

Received call from restricted number.  Didnt answer but got a message from the "process server department" that said I was getting sued and would be served papers sometime this week but if I called back right away there would be a 3 hour delay to receive the documents. This is the second time this month they have called. Strange thing is, they used the same name twice but I know it is a different person each time, I believe it is a debt collector trying to intimidate you into calling them back.  I researched a bit and learned my state doesnt even allow so called process servers. I even went to the court house and they checked my name....no suit or anything. This against the Fair Debt and Collection Act which states that a debt collector cannot say they are going to sue you without intent to sue, and cannot say they have sued you when they havent.

They called me today saying I have 24 hours to come to an agreement or I would be sued.

I received a call from this same company.  The person didn't identify herself or the company she was representing nor the reason for the call, but said they would attempt to contact me in person two times at the home and once at my place of employment.  I was informed to call them back at 1888-325-4412 and gave me a case number to refer to.  When I called, I asked what company I had contacted and was told SRS (Samuel, Roberts, Steven).  I was told they were a legal firm.  The male employee asked if I had a case number and I said no!  I am current on all my bills and haven't had any letters about any delinquent accounts.  I found out that a lot of these companies are checking out credit reports to find out who has charge offs or extreme delinquent accounts..  Then they call up the people demanding payment on those accounts without ever buying the accounts from the original creditors.  What the consumer gets is giving out a bundle of money to strangers without ever settling anything.  My advice is to ask the company to provide you with a copy of the original contract with your signature on it because that is what they are buying with the remaining balance.  If they can't, then they may not be legitimate.  If they take you to court, you can request them to provide a copy of the contract and if they can't then the case might be thrown out.  The legitimate companies pay pennies on the dollar for such accounts.  I don't believe in paying money to people I have never taken money from, borrowed from, or bought anything from based upon a threat.

I have received the same calls. I researched and found that there are other complaints that reference this phone number. I believe they are a scam buying old debt and claiming they have sued when they havent. You should check the staute of limitations in your state as many debts are past the staute of limitations to sue anyways. I have two voice mails from them, different people using the same name so I knew it was wierd off the bat. Everyone should check their credit reports and see if there were any inquiries into your report before the calls began. As previously posted, this is a violation of FDCA to provide a false name or to refuse to provide their real name to you. Debt collectors must also provide you with an actual company name, and they cant claim to have sued when they havent. I dont even think they are giving a real company name, heck they dont even use their real names when they call.

I also never received any notifications in the mail and my mailing address has been the same for 15 years. The court has nothing in my name either. Another violation.
