- DarcyLooks like a new scam because their website is new and hard to find any reports yet. I filed with FTC and Texas attorney general's office.
Received voicemail from person identifying as an independent process server from Gillespie County, TX from the number: 512-980-9203 and stating that I had 24 hours to contact Eller & Sloan, PC or a judgment/lien would be filed and served at my parent's address or to my address in another county (mispronounced). I researched and company website was set up 3 months ago. Not listed with process servers or with bar associations for Texas or Ohio. Clearly a scam. Address listed has many suites for rent and no suite number was listed. I did not contact the company because it appears to be a scam. Here is the message:
“Hello this message is intended for (my full name) my name is Olivia Pryor. I am an independent processor here in Texas on behalf of Gillespie County. I'm calling to inform you we received a fax notification from the firm Eller and Sloan. It is in regards to a potential judgment and/or lien it also states that is scheduled to be filed with the county tomorrow March 8. There is a 24 hour hold placed on this matter to give you time and opportunity to contact the filing party directly to obtain detailed information or resolve this matter voluntarily. If this matter is not resolved the hold does expire. A courier service may be dispatched to (address redacted), and if you're unavailable at this address the courier service may be dispatched (name mispronounced) County with a delivery address of (address redacted) or any other addresses listed or places of employment. You can reach Eller & Sloan to receive much more detailed information at 1-888-333-1505 and when calling please provide reference number (redacted) thank you”- Caller: Eller & Sloan, PC

They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency. They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer). They threaten to serve you at home or at work. They tell you that if they serve you at work then they will need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work. They also tell you that you will need two forms of ID. None of which is true. Process servers do not ever call ahead so that you can dodge them. Process servers get paid to serve papers, nothing else. They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”. Court documents are time sensitive and must be served within a certain amount of time. Remember that you can always call the local courthouse to see if there really is a lawsuit that has been filed against you.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

After some digging found out this is probably a new scam since only a few people have been contacted by them.

- Wayne H| 1 replyI received a call from them today with the exact same message. Word for word. Apparently over a Credit Card that I had in College. I’m 45 now. Lol. I don’t know how it is legal for these people to pose as lawyers, when they are just bad debt collectors. I called and spoke to my “Lawyer” at this fake place and all the information that she could give me, I could find with a simple google search. When I asked about specifics about the account in question, she could not give me anything more than the lenders name and the date it was “defaulted”. Pretty much, all a [***] debt collection company needs to know.

I've called the county processing number 205 728 0136 about 30 times and they never answer and says to leave a message, but mailbox is always full......

- ColeenI received the same message as Darcy a little bit ago, although my "independent processors" name was Joyce Brooks serving Ogle County, IL her number 815-287-9316....other than that, the message was exactly the same
