New York v. Encore Capital Group

On January 9, 2015 New York Attorney General Schneiderman announced that his office has obtained a settlement from Encore Capital Group Inc, a major debt buyer, for bringing improper debt collection actions against thousands of New York consumers. His office alleged that for years, Encore sued New York consumers and obtained uncontested default judgments against consumers who failed to respond to the lawsuits, even though the underlying claims were untimely under New York law. Under the settlement, Encore will seek to vacate more than 4,500 improperly obtained judgments totaling nearly $18 million. Encore will also reform its debt collection practices and pay civil penalties and costs in the amount of $675,000.

Colorado Administrator v. Midland Credit Management, Inc.

On February 2, 2015 the Administrator of the Colorado Fair Debt Collection Practices Act and Midland Credit Management, Inc., entered into a stipulation and Final Agency Order to resolve issues raised in the Administrator's investigation of the company for violations regarding a consumer complaint. On September 3, 2015 the business entered into a consent order with the Consumer Financial Protection Bureau. The Assurance settles allegations that the business bought debts that were inaccurate, lacked documentation,and unenforceable and collected payments from consumers using false statements and false court documents. Under terms of the Assurance, the business agreed to refund consumers $42 million, pay a $10 million penalty,and stop collecting over $125 million worth of debts. The Assurance was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law. *Keep all messages
*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.
*Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

It will take so little of your time and if you follow these directions you will not only have peace but will have extra money in your pocket for the aggravation. Or you can continue to put up with the phone calls. Your choice.
You need to send them a certified, return receipt debt validation, cease and desist calling, or "not me" letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it.

- WilliamsWe get calls all the time from debt collectors looking for another Williams. It is really frustrating. They very seldom leave a message, so after repeated calls I called this place back and told them they had the wrong number. They looked up and compared my name, my husbands name and family names with who they are trying to call and agreed they had the wrong number. They told me they would mark my number as the wrong one for the person they are looking for. Hopefully the calls end. Usually they do when I do this.
