- 618-239-9544This company is calling for someone. When I called to advise to take me off their calling list this man cop - total attitude with me. Funny part about it is that he had papers to serve on this person, but when I call and asked if they are a process server he said no. What trash.

- Rebecca L.| 9 repliesSo a month ago this man called and said he was trying to serve me with papers, but since I did not live at the address he would be nice and stop the court case, if I paid 300 dollars to him that day, then I hung up, he called a week later wanting to know why I did not call him back, he then sent me an email with the wrong date on it saying I needed to pay by June 10, 2010 and it was May 2011, 465.00
He then took another week off and has been calling me every couple of days, when he realized I had blocked his number he started calling private he calls my cell phone hangs up and calls my home.
this was for a debt from 2006... he says I owe 1,214.00 and I only took out a 200.00 loan!
I keep waiting for the cops to show up, as he sears they are coming to get me, he said he was going to garnish my wages, um I have no wages to garnish, and he calls my mother in law telling her I am going to be sued...
for sure there is a law against this?? and it has now been a month and he has not filed any court case against me, which is way over the 14 days he had to file... also he has sent me no paperwork only this crappy email, with the wrong date on it...
my husband thinks this is a scam... his friend told him that this is way over the 3 year statue of limitations since it was 5 years ago.. not to mention I am in a very tiny town of Alaska now... and he would have to come here to sue me..
also my husband says there are not debtors jails, that this man is crazy...
I do not want to go to jail...

- Nash replies to Rebecca L.| 2 repliesYou can't go to jail for debt....and the statue of limitations are up..He is correct on that.These are bottom feeders that buy old debt for pennies on the dollar...tell them to kiss off....plus only certain states can garnish wages..i am in NC..and only federal taxes , school loans, or child support here can garnish....no bill collectors can...you find out on the internet if your states allow it...I hope this helps.

- anonymous replies to Rebecca L.Rebecca L., legit collectors per section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf *must* tell you at initial contact, or send you paperwork within 5 days of initial contact, the following:
1. $amount of debt,
2. name of the current creditor (which may differ from the original creditor who might have sold your debt),
3. a statement that that debt will be assumed to be valid unless you dispute in writing within 30 days,
4. a statement that that if you do dispute in writing within 30 days, the collector must mail you written verification of the debt,
5. a statement that if you ask the collector in writing within 30 days, the collector must send you the name and address of the original creditor if it's different from the current creditor.
If you don't get the 5 disclosures, orally or in writing (you do not have to ask for them, the FDCPA requires collectors to provide them), treat the collector like you would any SCAMMER.
Has the statute of limitations for your state http://www.fair-debt-collection.com/SOL-by-State.html expired on your debt? If expired, don't pay.
Collectors generally have to be licensed by your state to practise (collect debt) in your state and you can find out by calling your state Attorney Generals Office. Ask if a license is required and does this collector have one. If not licensed, don't pay and file a complaint.

- jay replies to Rebecca L.yeah I got a call from these creeps about an old debt. Apparently they buy old debt and use arm twisting tactics to try and get what they can over the phone. They called around and threatened me and my parents. Some guy was on the yelling about how irresponsible I was and if I didn't send him $300 in one hour he was going to take action. So I reported him to the FTC - 18773824357. He didn't give me much info just a phone number and some sketchy company name CMAG (which he wouldn't say what that stood for). you can also call your State Consumer Agency.
