Call for, sending legal docs for court

The fake process server/location finder extortion SCAM usually consists of the following:

They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work then they will need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and must be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there really is a lawsuit that has been filed against you.

  It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

Federal law (FDCPA) requires them to send you a letter, email, or text (postmarked in the case of a letter) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. Unless they have communicated it to you verbally at the beginning of your conversation.  It also must contain the “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this communication must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that communication you should immediately send that debt validation letter by certified, return receipt mail.

Called several times looking for someone I didn't know. They said they were from Goldberg financial services? Scammers

Lawsuit pending. Phone number, case number. I asked where are your headquarters. He said all over US. Heavy accent. I said name one city. He said l'm sorry ma'am. Something something. So I said I'm sorry you're so stupid. He hung up. These people are very upsetting. Trying to scare you.

This is true!

I got the same call today too. Definitely a strong Middle Eastern accent.

Legal summons scam

You mean 'fake" Summons scam, right?

I’ve been waiting for a very important phone call and unfortunately because i was expecting that important phone call sometime this week I went ahead and removed all of the settings on my cell phone that usually block unknown numbers. This exact number (1-888-673-5107) called me today and like a dummy I answered it

A man with a very heavy accent started spewing a bunch of gibberish out of his mouth which was my first clue that the call was fake!!!!!

He said that there’s a legal case against me and that a process server tried to serve me some legal documents at my address but nobody was home

That was my second clue that this was a scam. I work from home and have video cameras all over the place including a ring doorbell camera that alerts me and records anyone who approaches our front door

Funny thing is they had my last name wrong but my address correct which was my third clue they were dishonest and totally full of s***

It really pisses me off that these idiots are even allowed to have our personal information in the first place!! Anyway, my entire family is pretty much law enforcement and I’m well aware how all of this works. There is NO process server on the face of this planet that would warn someone that they are coming lol

I told him to go f*** himself and I also very loud and clear let him know that I was contacting the police and the FBI and he immediately hung-up

It’s sad to think that these pathetic human beings are praying on those who have faith in humanity  and who believe what they say because I’m sure that they’ve taken advantage of several different people who have actually given them money

Called me saying they were going to serve me paper if I didn't pay up and they would put a lean on my house and cars told me they tried serving me so I went to the court house and there is no record they called me back and I told the they are fake and they hung up lol

My husband got this call telling him he owe hospital bills and they gonna put a lein on our vehicles and they coming this afternoon go our home to serve us papers from this exact smae numbers when i tell him to email me the documents so our lawyer can verify them he got so mad and hangup
